money after seperation

i have been seperated from my wife for over a year. she left me. if i was to start working or come into any money via inheritence/lottery win will she be entitled to it when and if she applies for divorce? rember the money gained is after seperation
Problem with having access to internet is that i get asked by many to solve their problems :( Well at least i learn something on the way :D

  • I should think you would need to speak to a solicitor about that one. As far as I now, if it happens once you're divorced then no, but if it's before then maybe, Sorry if this isn't more definite!

    I would keep it quiet if you have come into money, as she can't get half of anything she doesn't know about....

    Pretty sure it would be based on circumstances when you divorce not when you separate.

    Unfortunately, she would be entitled to a share. She would even be entitled to a share if you were divorced without a properly written up agreement stating that neither could make any claims on the other.

    When you come to complete your finances after divorce, you will both have to complete forms stating your income and savings, etc. You have to swear this document and if it is not true you will be committing perjury.

    Even if you have the proper agreement, if she finds out later you lied she can have the matter taken before a court.

    Even after divorce she can still have a claim on future windfalls and vice versa.

    When you go through the divorce papers, ensure that you also apply for a Financial Consent Order. That severs all ties with each other, so neither can ever make a claim on the other person ever again. Child maintenance is a seperate issue and not included in this order.

    I didn't apply for one, and bought my ex-husband out of the maritial home during the divorce. After about 8 months house prices shot up suddenly here. I then got a letter from his solicitor demanding £10,000 because he'd decided due to the price rise, the agreement we'd made regarding the house was no longer fair!

    My solicitor had to write to him and he did drop the claim for £10,000. He also agreed to get the Financial Consent Order, especially when I reminded him that when his rich parents die, I could consider claiming half his inheritence ;)

    The definitive answer is yes.
    A friend of mine was going through his divorce, but things hadn't been finalised. His mother died and he inherited her house. His ex insisted that half the value of the house was included in the divorce settlement; he had no choice but to agree. Callous b***h.
