BR day approaching

My first proper post I have completed my petition & filled in my SOA, I am solvent (£50) a month do you think the judge would throw my case out, I know this might sound silly will I be asked to sit in front of the judge & do a question & answer session & try explain how I got myself into this financial situation, Any info on what questions they will be asking?. Things to say & not to say in court, I don't wont to jeopardise my BR, I just hope I'm one of the lucky ones that's granted BR. Or will i end up with a BRO or BRU, Not sure if I'm supposed to post my SOA here.

I rent a privately furnished room in a house my only asset is my old run around which is only worth a few hundred pounds, I made an appointment with the CAB & explains to them by financial situation they explained the different options available to me, IVA was too expensive & DMP I would be paying for ever & a day, So my best option was to take BR,

Feeling very stressed at the moment trying to cope with all corresponding letters & bombarded with non stop phone calls received one 9 a.m. Sunday morning just what I needed, asking me to settle my account in full. Am I an legally bound to tell my creditors I am going down the BR route or just keep mom, The next thing I suppose is the bailiffs will come calling, My debt is mainly credit cards & two unsecure loan, I would love to be able to have a fresh start in life.

    Hi hun and welcome, I am sorry but i dont know much about this subject only the things i am learning myself. But did not want to read and run and leave you without saying stop panicking hun, There will be lots more knowledgeable peeps here in the morning who will help you. Please dont worry about the bailiffs. They wont be coming to your door hun, so lets get that one out of the way. What date is your hearing. Please dont fret, and when you are awake at this time of night and things going round in your head it all seems ten times worse. You do not need to speak to the DCA on the phone. Letters only. How much are your debts. I am not going to ask you to put up an SOA as i am not sure how this board works in relation to that. Dalip, or one of the peeps will advise you on that. You have nade the step in the right direction by asking for advice here. You are not alone, If you really cant sleep then have a read through some of the other posters stories. You could well find out some of the answeres to your questions in them.

    I suppose they could as that if you solvent how are you in a mess.

    Put your SOA on here so we can comment but there may be things that you have not put on SOA and should before going to court.

    Post you SOA up for us to take a gander at. Phone you local court and see what sort of system they operate(drop in bc or appointments)also ask how many copies of your SOA they need(this can vary from 1-3)the come back to us for more pointers. You will be fine we are all here to help you through it.D

    You have no travel expenses,tv licence,house ins,dry cleaning.

    You must have been advised to go bc by a legal advisor,not decided to do it yourself. If you have not been advised to go bc by the likes of CAB,CCS or NDL then your petition may refused by the judge!
    The OR will normallyask for 12-24mths cc and bank statements,copies of loan agreements ect.D

  • I am still going through this process myself, so the others will be able to give you better advice, but I shall try.
    I was in with the judge for only a couple of minutes, he wanted to know why I couldnt keep up with repayments, and whether I had sought legal advice. He then signed the BR.
    It is the official receivers job to investigate the causes of the BR. As far as I know you will need to provide one years worth of bank statements/ credit card statements, & all of the credit agreement paperwork. He will also want to know why you took out each loan/cc and what the money went on.
    I would think that your car should be safe if it is needed for work, but again I am no expert at this.
    Nothing else helpful to add im afraid, except that there is light at the end of the tunnel and you are doing very well to face up to your demons and trying to sort this out. :TAll the best. xx
