use of white disabled parking bays?

Hi I have a question about the use of a white disabled parking bay which has been put in place specifically for one particular person. Can anyone tell me, does the user of this space need to display a blue disabled badge? And is it possible to pass the use of this space on to other disabled persons when the original user has passed away?

I ask this as a friends neighbour has put a disabled space partially across the front of her house (although there was plenty of room in front of her own house) and then insisted that now the person for whom this space was intended has passed away the use of this space has been passed on to her (although she does not display a blue badge).

I am assuming she does this because she then gets 2 parking spaces in front of her house enabling her visitors to park there and keep an eye on their vehicles etc.


If my friend parks over the lines of this (quickly fading) parking spot even an inch (if for example someone else has parked on the other side of her normal place giving her less room to park) she gets threats of being reported to the council/police etc and so she has accepted that the place has been passed on and will herself and ask us, to park up the road if someone has taken her usual space, this is merely an inconvenience to her but is a pain in the !!! for me when I visit as I have a baby and so have to lug him and his possessions a long way just to keep this woman quiet.


Now I'd dearly like to know if I am legally able to tell this woman to bog off if I need to park there for 10 mins or so when dropping kids/ shopping off making a quick visit etc.


Any ideas?

    This says that these bays are advisory only and have no legal validity. Not sure if this applies to all authorities so best to check with your local highways department.

    If the person has died I would have thought that you could ask the council to remove the bay altogether.

    Just phone the main reception and explain and you will be put through to the right people.

    The space would have been given to one particular person and cannot be "inherited".

    I would contact the Council, both the transport dept. and the Social Services Dept. As far as I am aware (blue badge holder myself) you certainly have to show a blue badge when parking in any bays be them on or off road, when they are specifically for a disabled persons vehicle.

    If the person in question is not disabled then she is not entitled to use it and usually the bay is taken away (blacked over the white lines etc.).

    Yes best advice is to contact your council as rules are not consistant throughout.

    Have to say though what a lazy and spiteful biatch that women must be.

    I'd be inclined to report her each time she parks in the space without a blue badge, that should sort her out.

    Isn't it just easier to park elsewhere? You have no implied right to park on a road immediately outside a property - any road user can park anywhere unless there are any restrictions. If the bay is no longer valid or potentially likely to be removed there's nothing stopping her parking there anyway.

    But that would mean that she doesn't have divine right to park there either :confused: .

    I would definitely get your friend to contact the local highways agency / social services about remving the line if the person that it was intended for has passed away and then, like the rest of the road, the space is there for use on a first come first served basis.
