    hi claire i just declared myself bankrupt on friday afternoon . do nto worry too much it is very quick . the popel at tthe court are very understanding and sympathetic to your case even the judge was with me even though bankruptcy it is all my fault for not being able to say no to loan etc.. when i was younger.

    i will advise you to take as book with you as u can wait for a while to be seen by the judge.
    you will be seen na judge office quite small nopthing like in TV court drama ....

    the judge will ask you if you had taken any advise before ask you few question about your bankrutpcy and explained to you indetail about the implication of bankruptcy and the protection from the court while you are undischarged . i almost cried when i came out the judge office ...

    then you will have aphone call from the official reciever he was really nice with me.

    angelic,ary85 i would liek toknow why peopel should not be allowed to be bankrupt ? it is a very difficult decision to make by yourselve !

    Thanks Tigerfeet, still a bit confused i am being a bit silly!

    so I put that amount for dental etc and holiday where do i put this on the SOA? does it come under housekeeping? sorry it is prob a really silly question! :( just dont know where to put these things?

    The water is for the other house, as is the CT.

    The problem with the house is that its jointly owned and I did have a tenant in the house so they were just covering my mortgage payments, I moved out originally because the person I bought with turned out to be a complete nightmare so after 2 months moved back to my parents was a shame as it was my first house, :-( so then my tenant has moved out after 10 months as she cannot live with this person either, so I am now in the doo doo as one i cannot pay my mortgage myself and 2 have my other debts so it is a complete mess, what with the credit crunch and all there is no equity in the house, we have a 95% mortgage plus 30k unsecured against the house which was used to pay stamp duty etc, no option to sell as early redmeption fees etc and I have no way to raise the cash which would be about 5k, so am at a complete dead end with no way of getting out, it is very difficult as me and the other person who owns the house are not on speaking terms as she became threatening and abusive to me, so here I am now ready to go BR, just want to make sure everything is correct, so should I now take of the mortgage payments for the house off of the SOA?

    I really appreciated all of the help, im sorry to keep asking new questions x

    We don't mind you asking questions, the only stupid question IS an unasked one :D. You don't find out if you don't ask and we will try and help and support you all we can.

    If you are giving up the house then any expenses connected with it you won't pay when you are BR so do not include them on the SOA.. Any joint debts will fall wholly on the other person to pay, not half, all. Does the other person want to keep the house? If so she will haveto buy your Beneficial Interest (BI) off the OR.. Out of interest does she know you are going BR.

    If you would list out your SOA as it stands now that would be helpful. Are you a member of any professional bodies that you pay a subscription to? Do you have any pets? Don't forget TV licsence.

    Cheers Tigerfeet, so here are is my SOA without anything to do with that house and other debts coming out (my loans and credit cards etc) so effectively what I would pay after BR and not knowing how much the OR would take off me per month;

    Rent: 450
    Mobile Phone: 30
    Broadband: 20
    travelling expenses to and from work and train fares to meetings etc: £100
    Clothing: 40
    Housekeeping: food and cleaning products: around £180
    I do have 3 cats I havent included any expenses in for them, good point!
    If I include as you have recommended
    Dentist: 15
    Holiday: 30
    Haircut: 10

    Should I include money for the cats upkeep (vet bills etc)?

    And if so do i put this new information on the SOA instead of the old info and into what boxes?, just worried that if i do this then the judge wont be able to see what a mess I am in and reject the BR, cause they will think I have enough money but i dont if you see what I mean?

    Im not 100% sure what the other person wants to do she did ask me to sell but I dont have this option, so I am thinking that she wants to get out of this situation too. I havent spoken to her for a while the last time we did speak I was threatened and intimidated so contact has been avoided since then as I dont want to put myself in danger, so she doesnt yet know I am going BR (fingers crossed)

    If I include as you have recommended Put £20 down. If you don't have pet insurance I would suggest you get some ASAP.

The judge will see what resonable out goings you have and how much debt you have and see that what surplus you have will not pay the debt.

    Thankyou everyone for the advice given, I have now printed off all of my forms and am all set for the morning 9.15am, am pretty nervous and have lost my appetite for the last 2 days for worrying so much! I will be back tomorrow at some point to let you know how it went! fingers crossed for me!!
