the OP says in his post "she took the contents of the drink and threw the drink over his face and the glass", which i took as, she threw the contents and then the glass. this is how it reads.

i also said that i don't think his GF is a threat to the US because of this incident.

I must say that again took the contents of the glass and threw the drink over his face, glass never went near him just around his feet,no harm was done to the guy.

Thanks for all the advise and stuff, but we was going to wait till the 1st august for the esta visa if she got that then i seen no reason to worry or get any visa or go to the trouble, nobody anywhere i have asked these questions have not mentioned it,maybe not many know about it,everyone needs to do it starting next year but if you wish can be done from august.
Was thinking if we wait till this come out then see what happens, its like what they use in australia.

But does that not save people from going to an embassy and getting a visa, more so with her minor convictions and that they are not moral turpitude,as what would be the point in it all,im sure they dont want many more thousands turning up at there door for a visa when it kicks off next year Whats the point in having a electronic system,i suppose she has nothing to lose by trying as she has two other options after that or before that and that is take the chance and go,or apply for a visa,if she was granted this then she would not need a visa and thats what its coming out for,to save the hassle of going for a visa.

ESTA has been discussed previously on this site. Here.

The new online system is an extension of the Visa Waiver Program and is scheduled to be mandatory on Jan. 12, 2009. It asks for the same information as the I-94W. None of this changes anything really, if you need a visa you will still need a visa.

Yet from Aug. 1, it will begin to accept voluntary applications. (Website not yet operational)

Can’t put my hands on the information at the minute but using the online ESTA system from 1 August does not do away with the need to still complete the paper form 1-94W on the plane. This form does not disappear until 12 January 2009.

It will be interesting to see how this online service works in practice.

Can see many people chancing their arm by inputting dodgy information and getting the email giving authorisation to travel to the USA. What can the USA authorities do to someone in this country if the information is found to be suspect (to put it mildly) other than to refuse travel to the US?

On the other hand, as it is now, you fill the form out on the plane where if it goes wrong money is lost, you are returned etc.

I can’t believe the USA authorities haven’t thought of all these implications by bringing in the online service. Time will tell as they say.

Some info about ESTA. Having the application approved doesn't necesarily mean you'll get into the USA.

If an ESTA is approved it establishes that you are eligable to travel to the USA but does not establish that you are can gain entry to the USA under the Visa Waiver Program. On arrival in the USA you will be inspected by a US customs and boarders official who may determine that you are not allowed entry into the USA under the visa waiver program or for any reason under US law.

If an ESTA application is not approved this does not stop you from applying for a visa to travel to the USA.

Is it not possible to avoid the visa issue by travelling to canada then driving to the usa for a few days visit.Or will the visa still be required,I ask cause a friend of mine went to canada for a holiday and then went to the states for the day and no visa was requested. But it may have changed now.

obviously if you apply under this scheme and fail you won't be able to travel using the VWP ....they have got all your info at that point.

No it's not possible (to avoid the issue). To enter the USA from Canada (on a British passport) you either need a visa or a visa waiver. Your friend will have applied for, and been granted, a visa waiver at the border, in just the same way as if he had arrived direct by plane. (Apart from paying the fee direct rather than through the airline)

If you apply under this scheme and fail, then you wouldn't get in under a visa waiver anyway - the questions are the same so you've either given a 'wrong' answer or they have already some unfavourable information about you.
