Insurers will want to do a 'quick and dirty' on this one and get rid of it for the minimum amount possible. You will have limited opportunity to stop them settling - particularly if they have already admitted liability.
One thing - did you tell your insurers about it at the time? There may be contractual requirement for you to have told them about all incidents irrespective of whether a claim was immediately likely.0 -
Just wanted to add that a pedestrian who ran out in front of my FIL's car has been trying to claim, but it has been turned down by the insurers on the basis of a police report and witness statements.
The man was running across the road and the report says there is nothing my FIL could have done to avoid the accident, so they ahve refused to pay out.
The pedestrian has refused to close the case but his time is up this Friday :beer:
So just wanted to add that sometimes insurers will defend you against 3rd party claims if they think there is no basis for them.
In this case the fact that there were witnesses helped.
It's much harder when there are no witnesses but they do have ways of sussing out people who are not being honest e.g. medical records.0
