Reinstated employee but job has been filled by a new person.

    Actually I know someone in practically this position.

    They are employed, have been ill and receiving phi via employer's benefits package. They had hoped to return to work once fully recovered. A friend from work has told them that the temp employed originally to cover their work has now been employed permanently. It's a small department with no possibility of alternative employment.

    Presumerably when my friend indicates she is ready to return to work, the subject of redundancy will loom ?

    But what if there are no other jobs to put the newbie in? So the old person would have to be made redundant anyway.

    For asserting basic rights like paternity leave or minimum wage.

    That and all the others you have mentioned is quite a list, isn't it, given that there is a general view that you basically have no employment protection in the first year of employment.

    You have a lot but you are not really protected from bullying at work, which is the biggest problem in the UK workplace as I understand it. So there is nothing to stop a bully doing what they like or even getting rid of you in the first year.
