help needed please

Hi
i recently won a phone on ebay,in the description it stated that it was unlocked it also stated that it was only a week old.
it arrived today and it is locked to o2 and it has a few scratches on the camera and on the sides of the phone.
i have emailed the seller but no response.
i paid over £200 for this phone as it stated to be unlocked if seller had stated it was locked to o2 i wouldnt have bothered or i would have got one cheaper else where.
what can i do??

If you paid through paypal then start chargeback proceedings under the Resolution Centre for 'Item not as described' which clearly it isnt since its locked and on its condition . Do not alert the seller of this just do it, as once its activated it will freeze their account and any money still there. If your successful and paypal goes in your favour then you should get your refund back but possibly not the postage costs. Keep any emails you sent the seller, if they were sent through ebay then they automatically keep a copy. If the seller does get back in touch and offers a refund then make sure you send it recorded so you have proof and take pictures of the phone before returning, but im guessing he wont. If paypal isnt succesful then try your credit card company if you paid via this method they'll send you a chargeback form and if successful they will get your money back but use them as a last resort if paypal doesnt work. If you have used a different payment method ie cheque or postal order then your only option is the ebay protection programme. Hope this helps.

Like nas said paypal is your friend in this instance.
Normally I would suggest asking the seller for a refund before going to a chargeback, but since your seller has not responded just start the chargeback on day 7.
If you didn't use paypal then come back and ask again as you will have to use the ebay system which will cost you an admininistration fee and also has an upper limit for claim which is less than your total loss.
