anyhoo, I was just wondering if I have to take any statements tomorrow?
and should I be really really scared of the OR?! the worst that can happen is a BRO isnt it, which to be honest I dont think I care!
the lady at CAB said the amount I owed was minimul compared to some people, its just im out of work at the mo and the family is struggling I owe approx £12,000

Hi Kelly,
Tomorrow, although it is very nerve wracking from a personal point of view, it is very clinical and really nothing to worry about. (Although you're probably thinking, she can say that she;s already done it.) Make sure you take something to read as you can be hanging around for a while and maybe something to eat/drink. Each court seems to be different, some people have OR interviews straight after the bankruptcy hearing, some people have to wait. I took my statements along with me just in case although my OR interview was a week later.
I was petrified of my OR and dreaded the telephone call. Although it was uncomfortable at times admitting where I'd made mistakes, he was very human and matter of fact about it all. I think it was more about my attitude and reaction to the whole bankruptcy than how he made me feel. It was about an hour and a half and really quite painless apart from the emotional fall out afterwards
I would agree that the worst that can happen is that you get a BRO which is unlikely unless you fail to cooperate with the OR or they decide you have deliberately disposed of assets before you go bankrupt, or you get an awkward OR(I'm not meaning to scare you by all this honest!)
I'm sure that you will be fine tomorrow, make sure you have your 3 copies of the forms and any proof if you're claiming back the £150. Take care and let us know how you get on.

Hi and welcome to the board.
All you need to take is your forms, money, a drink, a snack and something to read.
As long as you are truthful with the OR you will be fine. Have a look on the board for OR interviews.BSCno.87The only stupid question is an unasked oneLoving life as a Kernow Hippy0 -
Hi
thanks for your replies, Im bringing my mum along for moral support tomorrow!! With regards to the OR, I dont think they will be happy as I drew the cash from my CC to go bankrupt, but it was really getting me down!! i will be honest and explain.
My dad has gone BR! so I kinda know the process, he was very matter of fact about it all. But I dont feel happy with my self about it, I ran up all the debt when the bank gave me a loan and a credit card, wven though they knew I wasnt working!! when I was 18, young and silly!!
I have read through a lot of posts and found them very helpful.

Thanks that has made me feel better,
My DH told me his mate went BR and got a £30,000 loan first and spent it!!
so I guess the OR has most definately seen alot worse than what I have done!

I would like to second what Frosty has said. It is one of the ways we recommend to raise the money if there is no other way, so don't panic.BSCno.87The only stupid question is an unasked oneLoving life as a Kernow Hippy0

Hi there.
I should not worry about the figure of £12,000, I have known bankruptcies involving around £4,000, everyones circumstances are different.
If the District Judge asks to see you, try not to worry they are there to help you, just tell him or she how it is and that you have had advice and you will be ok.
If you are out of work, there should be no question of an income order, if you have any problems just post them on here, there are plenty of good people on who will help and support you.
Good Luck.

Hi
Thanks, Is there any circumstances where the judge will say no?!
im sure I read on here the other day that someone said they couldnt go bankrupt, because they still wouldnt have any income left over?0 -
Hi,
Technically yes, the judge can refuse bankruptcy in some circumstances, for example.
a) If your forms are not completed fully and / or you have not had professional advice (the court staff usually pick up on this when processing your forms).
b) The judge could discuss and recommend an alternative such as an admin order (debts would have to be under £5000 and CCJ in place) or an IVA (you would need to have debts of around £15,000 or more and have assets and a min disposable income of around £200pm)
From what I have read you have none of the above, so if you have had advice and your forms are fully completed and you have the correct money for the fees, then there should be no problems for you
Hope this reassures you some and again I wish you good luck.
