help me liittlewoods/choice debts

I noticed on some other threads the deal with getting them to provide the cca agreement both sent this as I requested a true copy of my signature.
They both sent one not signed!

Does this mean they dont have it and trying to fob me off?
Choice sent me a scary letter which goes like this

We refer to your recent letter and now enclose a true copy of your agreement with shop direct finabcial services ltd trading as choice
thsi a/c was opened
at which time you agreed to make payments of 1/20th of the outstanding balance per week

the account was passed to our collecters general credit company on 27/sep to recover tha balance
the outstanding balance is £800 payments shoudl be made of 1/20th of the outstanding balance per weel currently £40 per week since the account was opened payments totalling £402 have been recieved.
We look forward to recieving confirmation that liablilty for this debt is not disputed together with your proposals for payment on the outstanding balance.

Does this mean I need to pay cause the cca they sent didnt have my signature on it?

Please help I really feel out of my depth serves me right for trying to be smart.

    Should I send another letter quoting the cca in the other lead and put it on that I want this written off?

    I'm really scared dont want to go to court for this?

    Hi there.

    Yep thats what I'd do. If they can't provide a copy of the signed agreement they've got no defence in court. If they do have a signed copy they have to send you a true copy.

  • They're trying it on. Use this letter to reply to them, wait for the response.
    Reference:

    I am in receipt of your letter dated xxx; the contents are noted. The item and confirmation that I requested from you has not been supplied.

    1. I requested a true copy of the consumer credit agreement that you state exists; to which I am entitled to under the Consumer Credit Act 1974 (CCA). The supposed copy that you have supplied is not a true copy; there are major errors in the information contained therein. I would draw your attention to the following. It is an offence under Section 40(1)(c)/(d) of the Administration of Justice Act 1970 to falsely present a document as having some official character which it has not, with the object of coercing another person to pay money claimed as a debt due under a contract. It is also contrary to the provisions of the Section 25(2)(d) of the CCA to mislead the debtor as to the origin or authority of any document.

    2. I requested you to confirm whether or not you entered a properly executed and signed consumer credit agreement for the above account. This you have not done. As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the CCA and therefore is a complete defence to any court claim that is issued. Take note at this stage, that any legal action you may contemplate will be both vigorously defended and contested.

    As the information which was requested has not been supplied, take this letter as notice that both the account and the amount you claim is owed, are in dispute. They will remain so until the requested information has been supplied.

    I have nt had any goods from Littlewoods for 4 years and balance woz 80 quid but i still owe them 100 quid because i pay some off then nothing for months i prob paid about 300 quid in late payments up to today. Now its been passed to NDR for the second time i can't remember signing a credit agreement because it woz about 12 years ago.After reading several forums on Littlewoods and NDR i have now sent Littlewoods a cca request should i send NDR the same and whats my next move.
