unsigned credit agreement

Hi, I sent off for my littlewoods credit agreement last week and recieved it this morning,unsigned.So what do i do now?It didnt say much in the letter just basically heres your credit agreement you asked for.Im suprised i got it really as it it didnt even have a stamp on it!

They are just trying it on. Send this letter back to them, by Recorded Delivery. Just add your reference number and the date of their letter.Reference: Your reference number
I am in receipt of your letter dated (date); the contents are noted. The item and confirmation that I requested from you has not been supplied.
1. I requested a true copy of the consumer credit agreement that you state exists; to which I am entitled to under the Consumer Credit Act 1974 (CCA). The supposed copy that you have supplied is not a true copy; there are major errors in the information contained therein. I would draw your attention to the following. It is an offence under Section 40(1)(c)/(d) of the Administration of Justice Act 1970 to falsely present a document as having some official character which it has not, with the object of coercing another person to pay money claimed as a debt due under a contract. It is also contrary to the provisions of the Section 25(2)(d) of the CCA to mislead the debtor as to the origin or authority of any document.
2. I requested you to confirm whether or not you entered a properly executed and signed consumer credit agreement for the above account. This you have not done. As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the CCA and therefore is a complete defence to any court claim that is issued. Take note at this stage, that any legal action you may contemplate will be both vigorously defended and contested.
As the information which was requested has not been supplied, take this letter as notice that both the account and the amount you claim is owed, are in dispute. They will remain so until the requested information has been supplied.

Sent the letter recorded delivery two weeks ago but guess what littlewoods havent recieved it and royal mail cant trace it.Just rang Littlewoods up and they told me to send another letter and they will pass it on to the correct department ,they were very pleasant not at all what i expected.Now to get typing another letter,hopefully this one will get there.0

I have just recieved a letter from Littlewoods saying they will not be pursuing me for the outstanding balance on my account woo hoo!It will stay on my credit file as unsatisfied though which doesnt make a great deal of difference to me anyway as my credit file will be shot to pieces now we are undertaking a DMP with CCCS.Thanks again Harassed for your help with the letters and good luck to everyone else . :j0

Because they're greedy and are scared you'll change your mind.if they can't prove it why does it stay on teh credit file as unsatisfied?
Two different things. Being unable to prove the debt legally is no bar to recording a debt with the CRA's. Besides which, Experian - the biggest reference agency - is owned by GUS. One of the biggest catalogue companies.0 -
