    As the breach they have admitted to is in relation to the consumer credit act. This is what makes the debt unenforceable.

    The credit file information is governed by the Data protection act.

    The only way to get this removed is to go back to littlewoods and ask them to verify the data they have submitted, if they are unable to do this in the prescribed time scale ( 40 days) then the matter can be escalated to the information commissioners office with a view to obtaining a compliance assessment.

    If the ICO concur that there has been a breach the data will be removed

    Wrote to Littlewoods back in september, asking for signed agreement. Sent £1.. which was cashed. Although no credit agreement has arrived.

    Wrote for a second time on the 20th of this month..

    SURPRISE, SURPRISE......... NO REPLY.

    I`m getting extremely frustrated with them.

    Want to call them, but haven`t got a clue what to say, as I don`t want to get into a slagging match, like a previous thread mentioned.

    Can anyone think of something good to say!??

    Yes, you are in breach of your legal obligations, please send me the agreement , statement of account and default notice by return or I will have no option to contact trading standards !

    Also as it has now been in excess of 40 days form your original request you have the legal right to request that this entry is removed from your credit file as unsubstantiated.

    you will need to complete a request for assessment and the ICO will rule on whether littlewoods have complied with their legal duty under the Data Protection Act

    Hi liz
    Basically all i did was ring them ,tell them i had sent two letters asking for my credit agreement and hadnt recieved it.They were not nasty or argumentative,just asked me to send another letter and they would look into it.Two days later i recieved a letter from them saying they wouldnt be pursuing the debt.You have the high ground on this liz,and they know it so just stick to your guns.

    Have now recieved an UNSIGNED copy of my aggrement and a letter saying that they presume buyers sign it - blah blah..

    Going to use to template at the beginning of the thread to write to them again !!

    I`m due to send a payment before the 6th Nov. Do you think I should or not??

    I wote to littlewoods requesting my copy on 24 June, i've still heard nothing from them.

    Hi, I have followed every bit of advise on this site to try and get my credit card company to send me a true signed copy of my credit agreement but to no avail. After several letters to which I copied from this site and several phone calls later all they keep doing is calling me day and night to make a payment. I have now put a complaint into the financial ombusman service but all my credit card company said was they will put my case in with a collection company. What can I do now? Help please as I am at my end with all this hassel.:confused::confused::confused::confused:
