Going Br In Scotland - Me First Then Hubby - I&e - Someone Please Take A Look?

Hi all. Situation in brief:
Moved from England last year, house value dropped by £30k and now in neg equity. Mortgage company won't allow us to rent our english house out any more and in 6 months arrears. Repo hearing in August. I have no income so am going to start BR through LILA in Scotland. Husband will have to wait to be able to go BR. Can someone please take a look at these I&E and let me know if okay? We currently have basic Sky, phone through BT and broadband from Virgin. This amounts to £78. If i go Sky on all and just rental of phone through BT it would go to 46. Would this be allowed (husband needs broadband for work - this is unlimited phone calls as well so no extra bill). I will put it down as Sky Phone/broadband. Me, hubby, 8, 6 and 3 year olds. 1 dog, 1 cat

Oil - £120
Elec - 120
C Tax - £214
Sky Phone/broadband - £46
Car ins - £35
House ins - £20
Life Ins - £150
Food - £600
Clothes - £70
Hair - £20
Dental - £20
Dog/cat - £30
Kids clubs - £50
HOliday - £40
Emergency - £30
Petrol £150
So this is £2610. Hubs income is £2430, child ben - £160 and tax credit - £40 (£2630)

All the above figures are accurate (although admittedly i have never put an allowance in for hair, dental, emergency or clothes). Council tax is high cos it is over 8 months not 12. Oil and electricity - we only have heating on from Oct - May 1st for 8 hours a day.

    All the above suggestions are based on english bc so not sure if the same applies in scotland. There are some scotish posters going through bc at the moment so may be an idea to do a forum search.D

    Oil - £120 You will probably have to justify the amount you pay for oil and electric.
    Elec - 120 because this is very high.
    C Tax - £214
    Sky Phone/broadband - £46 just put this down as phone.
    Car ins - £35
    House ins - £20
    Life Ins - £150 very high. What type is it. The OR may take an interest in this.
    Food - £600
    Clothes - £70
    Hair - £20 £10 each for adults £5 children
    Dental - £20
    Dog/cat - £30
    Kids clubs - £50
    HOliday - £40 you could up to £50
    Emergency - £30 leave in. some OR's allow some don't, might be cut.
    Petrol £150

    A couple of questions for you:

    Who has said that you can go BR via a LILA ? as you co-own a house ????

    If you can do a LILA then i & e is not applicable, but it will be when your hubby applies for BR.

    In addition to other comments, I also think the food bill is high. You could halve it fairly easily IMO, or work harder and get it down to £200.

    Good luck with it all, I'm sure it's a stressful time for you all, but stay positive. :)

    Lunar an I&E for BR is quite different to a DFW SOA and what the poster has put down is acceptable.

    Sorry - bit confused now -but thanks everyone for replies - can i just ask a few more?
    1. Food - is £600 high for 5 people? It used to be £400 or less but even with shopping at lidl i can't seem to average less than £150 a week. this includes 36 dinner money per week.

    2. Oil and electricity - this is not an estimate - i have the bill. it can be prove3d and, as i said, heating is only on from 6.30 to 9 am and 4 till 10 pm from end oct to beg may. electricity may be slightly higher than it should have been as the immersion had been on for a few weeks and we didn't know this as had just moved in. So perhaps over the year it should have been about £300 less. but again, have the bills to prove usage. In addition to the oil used we have open fires - again, re the money for food, about £10 of this is for logs/coal every week. If i can prove usage with bills will they allow this amount - i know it's astronimical - oil is currently 55p a litre.

    3. life insurance - these are death policies - theres about 3 that were taken out at different times as and when we moved and got bigger mortgage in past. they are not cashable - if we start a new policy would it be cheaper now? I know i need to look into this.

    4. LILA - the house is being reposessed and in negative equity anyway - there is no asset - various debtlines have said i can do this - can I not?


    i will look at the cutting down food board cos i have been really trying with this - i bought the cheapest chicken - £3.74 fuoll of water and have made 3 meals out of it. its the fruit and veg and toiletries, even lidl brands tha seem to add the bulk up. we also still have pull up nappies at night, 2 prescriptions a month so it all adds up.

    more homework to go and do now! every answer throws up another question!:confused:

    Go and have a read of the accountant in bankruptcy website, it has lots of pdf leaflets to download that will explain everything.

    If you are going ahead with a LILA just for you, you will not need to fell in a i & e sheet, there is not one on the form.

    When it comes to husband's BR then this will be needed. The figures you have put down should probably be okay. BUT this doesn't mean that this is what you need to spend. If you can cut down on actual expenditure it will ease things a little. Have a look on the OS board - I think the key is planning.

    As regards the life policies, IF these are simply to pay out on death and have no value, it may well be worth canceling them all and getting one new policy for the amount required - however if you will have no mortgage are they actually needed ?

    Have a look at a prepayment certificate for your prescriptions, it MAY work out cheaper.
  • Im sory to be personall, but where in Scotland do you live? I am in a aberdeen, one of the more expensive place and my rent is only £250 a week. You maybe told that you should move somewhere cheaper smaller. As your children are quite young, they could argue that you shouldnt be in anything bigger than a two bedroom. Your life insurance is FAR too high, mine is only £15 a month. you should look into whether your OH gets any free with his work, I get 5 x my salary free with mine. Food does seem a little high, although for me and my two kids I got told I could use up to around £500, so I guess it is acceptable. Council tax, you should divide by 12 months, not 8 even if you are paying it over 8. otherwise for the 4 months you are not paying, they could want that £200 from you. In my claim I have included this years council tax, have you considered doing the same? Holiday and Emergency funds might not be accepted. it is variable as to whether they are or not.

    Sorry if I am just repeating others, they are my veiws and I meant no harm, when I have said they might tell you your accomodation is too expensive, it is my personal opionion, so dont worry about it too much..

  • Also, You can do bankcrupcy through LILA if you have no income, income under £218 (or £228), get working tax credits, AND have no assests worth more than £500 and total assets worth less than 10,000. As you said that you do not have any income that should be fine, but they might argue that your household has income if over 2.5k a month, way more than within the guidelines.
