Dont know what to do just had enough...

Had an accident in Febuary 2007, Nobody involved just myself a cyclist saw it he seems to think i hit him despite been no damage to himself or the bike... The police came and took a statement and had the car towed didnt mark the road or photograph etc.. I then rang the court as i have a fine for previous and he said which fine are you paying, baffled i asked what he was on about. He explained that in Sept 07 i was fined £250 and given 6 points by the local court for Careless driving.. ok didnt make much of it until Today.

Went to rent a van and had to ring the DVLA to confirm my 6 points as i didnt have the paper part of my license, the girl on the phone told me my license had been revoked as thwe accident happend within my first 2 years althought the court case wasnt until sept 07 way after my 2 years.. however having read through the paper work the court sent me all the letters from the court etc.. i had moved address but they didnt bother sending anything to my new address so never knew about the court case there is no physical proof i was driving "Careless" the Cyclist and a car about 500 metres behind cant tell how fast i was travelling (was a 60mph road) and the bend i had the accident you cant go any faster than 40mph if you wanted it is that tight, the road was wet and very muddy. The copper didnt take any measurements/photo's markings etc so cant justify i was speeding, driving careless etc.. is it too late to do anything about this as i need my license for work... i am that depressed i just wanna curl up and shut off :-(
nobody has had any thought to tell me about the license been revoked the court never told me and it doesnt state in the paperwork from the judge/case that my licese has subsequently been suspended/revoked.

    Well that just sounds like complete incompetance on the part of the court/police. I've never had any experience myself so can't really help but I would definately take the issue further.

    Did they know you had moved? Why hadnt you chased the paper part of your license

    Speeding doesn't have to have any bearing whatsoever on careless driving. For example, if you pulled out of a side road in front of a cyclist, you could be charged with careless driving even though you were only doing walking pace. It seems that this is the line that they've gone down - that you weren't observant enough and hit the cyclist. The fact there's no injury or damage is also irrelevent as an accident occurred.

    The two years, AFAIK, is taken from the date of the offence, not the date you appear in court.

    It was also up to you to inform people of the change of address.

    What's really worrying is how long the 6 points have been on and whether or not you've been effectively driving unlicenced and also uninsured from that time.

    You need to phone up DVLA as soon as possible to find out the status of your licence. If it has indeed been revoked due to the 6 points in 2 years rule, you need to get some lessons and a test sorted out as you would need to take a test again and not drive anything until you've got a provisional through.

    Why was your car towed?

    You gave the police your address as it was @ Feb 07

    You moved address, but did not tell the police - did you tell the DVLA to change your driving licence address?

    The cyclist statement may have had little to no influence on the case, the careless driving could be based purely on the fact that you did seem to crash your car (you were towed).

    You need to check with the cyclist that he isn't persuing a case for damages against you. If you informed your insurer of the accident in Feb 07 this will not be a problem, because your insurer will cover it.

    You should at least have informed the DVLA of your change of address. I really think you need to enquire further though the reasons they have done you careless driving. Given that you did crash your car you may find it difficult to argue the case though. You also could also find out if any correspondance was ever sent to you other address?

    Sorry that happened if you, book a test asap you can re-take it and start driving again for work. Then appeal against the court decision. This could take a while so just re-do the test first.
