Watch not as described from ebay

can anyone help?
ive just recieved a watch that I bought from an ebay seller in Canada but it isnt the colour that they described it as. i asked him to confirm the colour before buying it now and he said -
"The watch is definitaly purple but this model does come in brown and black but I only have the black and purple at the time being"
so on this basis i went ahead and bought it through pay pal. but after seeing it today its definatley brown! so i phoned the manufactors (inter city watch co) and got them to send me an email with the model number on it and confirming that it is only in brown.
ive emailed the seller asking him to contact me so that this can be resolved but what are my rights. i know i can open a pay pal dispute if they arent going to refund me (defo dont want the watch) but with things like pay pal disputes do you end up losing money anyway, like on sending the item back etc? sorry for all the questions im not a very experienced buyer!!

Firstly, it may be a genuine mistake. Give the seller a little time to respond and see if they are willing to rectify the issue to your satisfaction.
Failing that, yes you can open a 'item not as described' dispute however if you were to return the item under this process the return costs are not refundable unless the seller offers to pay them for you. Also, you would need to use a trackable method of returning the item, probably Royal Mail Airsure so you can prove it has been returned. Airsure isnt cheap but it gives you the confirmation of recipt you need.
Work with the seller as far as you can to see if you can pursuade them assist you and minimise your costs.0 -
yeah i hope it can be resolved without a dispute. its a bit rubbish that you have to pay to send the item back (unless the seller offers, as you say) so in the end up you end up being out of pocket a bit anyway.

Also check out the buyer return policy. They may not refund the P&P you paid either..
Another option would be to try and resell it and maybe break even0 -

If you have a seller who tells you to send an item back for a refund but they won't refund the original p+p you paid then you might as well file a dispute. Winning a pp dispute will get you back all of your original cost (assuming they have the money in their pp account) I certainly wouldn't send an item back and be out of pocket twice.:heart2: Love isn't finding someone you can live with. just a wee update and another question!
i contacted the seller who advised that in the watch catalogue the watch is described as dark purple and the the sales rep who sold it says its purple too. i have now done a bit more research (should have done this before i bought the thing!) but its on the offical Police Watch website and its described as brown - http://www.police.it/fashionWatchesDet_eng.php?id=52 although the picture is very deceiving.
so i sent this to her asking if i could have a refund of the full amout which i paid, including postage and she advised that i could have a refund of the watch but only half of the amout i paid for postage (total postage was 19.99CAD) so basically she is saying i have to send the watch back at my cost (approx £12)and and im also losing £5. She also offered me to keep the watch but give me a £10 discount back.
i dont think thats really fair, would any of you open a dispute over this?
ive been reading pay pals dispute T&Cs and it says this -
An item is not Significantly Not as Described if:
The description could have been reasonably misinterpreted. To get full refund you will have to send it back via trackable means. So that is going to cost you.
Anyway it would appear that from what you said is that you didn't do your research so why not just keep it or resell it on EBay with luck you will make a profit.
I am not wholly convinced the seller is the wrong here and colours on the net can be very deceiving at times.0
