Found out my employer lied to me about the reason I lost my job.

Redundancy and retrenchment
Retrenchment is the act of being made redundant, that is, the job is redundant (of no use) and the employee is retrenched because they no longer have a job to do. Redundancy applies when an employer decides that an employee's job no longer has to be done by anyone. The employee will be retrenched and the position will cease to exist. It is important to note that redundancy has nothing to do with an employee's performance, conduct or abilities. It is also important to note that under the definition of redundancy, the employee's position may not be taken by a new employee, because the position must no longer exist.

I am under threat of redundancy - the reason "your role has diminished". This is utter rubbish. I have documents discussing how my role will be split between 3 other people (not that my employer is aware of this of course!).
Is this grounds for unfair dismissal?0 -
if they have the same jobtitle etc then it would be unfair but if they were to be a different title etc then this wouldnt be

I think you will find that the OP, in the first post, specifically wrote that the letter received was not giving redundancy as a reason: redundancy was the suggested in the face-to-face meeting and thus there was a mis-match.0 -

It is accepted that roles can be split and shared amongst other staff and this is a legitimate way of dealing with redundancy. It is also possible to "bump" the work round so that a different person is dismissed on the grounds of redundancy.0 -

Unfortunately 10 months doesnt give you any redundancy rights at all

Thing is. I don't even want any redundancy rights. I wish she would have told me the truth. If I'm not growing in the same direction as the company, fair enough. But to tell me she can't afford me then hire someone the next week is a bit hurtful.0 -

10 months is a testing time for employer and employee.
Usually you have got through any 3 or 6 month probabtion period but after a few months more the employer may feel the employee unsuitable in the role?
With possibly a months notice in the contract of employment the employer has to make a decison by 11 months at the latest - otherwise it is a difficult route to get rid of someone after 12 months.
It sounds like this employer had decided that someone else was required with perhaps different skills or as you say, more experience, and was doing what she could to soften the blow.
Unfortunately Employers do not get it right all the time and it is obvious you were mature enough to be given the full picture.

It's given me some skills to take to my next job. I'm really not bothered about it. I know the new person does have more experience and I am beyond fine with that. I think it's just the history of her mood swings/other things that annoyed me about her lying. I've decided not to dwell anymore because it'll just depress me. So I'm going to wake up at my normal time, have breakfast, watch kids morning tv until 9, get a shower and get my unemployed !!! to jobcentre. :rotfl:0
