Trying to return software to Dell!!

I bought a desktop computer from Dell the other day and ordered Microsoft Office 2007 pro for an extra £199.99.
When it all turned up I changed my mind about the Office software and called them to find out how to send it back. They told me they can not take it back and refund me, as it was pre loaded onto the machine. Something in the T&C's about custom integrated material.
The software is still in its sleeve with product key etc, and the seal is untouched. I didn't ask them to pre-install it, and why did they send a sealed licensed disc? Consumer direct advised that under the distance selling regs they must refund me. I dont want to send the whole system back, and I have deleted office from the computer and haven't agreed to any licences.
Any comments appreciated.
Thanks
Luw.

What did the contract and T&Cs say about buying software at the same time as a PC? Did it say that they were going to pre-install it?
Can you not just return the whole PC and get a full refund for the lot?Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -
Trial versions probably come loaded with all Dell machines, all they have done is activate it for you, which would need the disc sealed or otherwise.
The disc is there for you as a back up should you need to reformat your hard drive.
Possibly as you have unistalled it you could be classed as having used it and therefore not entitled to a refundIt's taken me years of experience to get this cynical0 -
Did you get the system custom made by them, i.e to your own specifications in any way? DSR do not apply to such goods. In addition I'm not sure how the DSR apply once you've altered the product (deleting the software) as simple as it is to fix this for them it is still altering the product from what they have sent, again i'm not sure how the DSR deals with this or if it even matters. What I wouldn't suggest is that you now reload the software as that definitely would stop you from returning under DSR as unsealed software is exempt.Bought, not Brought0

Yes i would return the PC, Dell give 7 days to cancell your order , software is non returnable under the DSR0

Software can be exempt yes as you can copy it, trouble is you have it installed on your PC so you can now use it, whats to stop you sendning the disk back and telling Dell you have deleted it and carry on using it ? (not saying you would tho !)
I think the easiest way is to ring up Dell and ask for them to pickit up then you will get a full refund, they may offer you a refund of some sort to keep the PC as i ve heard they often do this0 -
Dell's T&C's
7.4 Consumers' right to cancel Software that is supplied on CD, DVD or other similar storage devices is also lost if the Software is unwrapped.
From what I've seen in your post I think that applies as the seal is untouched.
If you didn't agree to the EULA then I think Dell have to refund, as I believe it says in the EULA for Office that if you don't agree to the EULA to return the software for a refund."One thing that is different, and has changed here, is the self-absorption, not just greed. Everybody is in a hurry now and there is a 'the rules don't apply to me' sort of thing." - Bill Bryson0 -
Thats a good point tell then you dont agree with the EULA0
