Not sure what to do

I bought a belt on ebay and a week later it arrived but had 5 stones missing, it had a big diamante buckle and the missing stones made it look terrible and there was no mention of it in the listing. I emailed the seller and they were a bit rude but agreed to a refund so I sent off the parcel recorded and a week later hadnt heard anything so emailed to see if it had arrived and she said she hadnt received it so i hunted out the recorded slip and checked royal mail who said it was refused or couldnt be delivered so was being returned to me so I emailed her again (I think you should always give the seller the chance to put things right) and she said she has moved since which is why it is being returned.
So now to my question, the belt was only £6.70 and I have already paid £2.60 to try and get it back to her not knowing she had moved, surely she should have told me? So who is liable for paying the postage again? If I have to pay twice there is really no point but there wouldnt be a problem if she had told me her new details when we agreed on a refund.
She isnt really approachable so I just dont know what to do, I am always reasonable to sellers cos reading what some of yous go through on here makes me feel bad! I have never had a single negative in 6 years and over 40 transactions and never had to even deal with a return in all of that so not sure what to do! Thanks

have you openned a dispute about this? sounds like she's being a bit of a pain and it is very stupid of her not to give you a correct address!:happyhear0

I think you are going to have a real problem returning the item for a refund.
Did they send it to you recorded or special delivery if not I think the only way to get your refund is to open a not received dispute.0 -
Personally I would be inclined to pursue, but I am bloody minded and dislike people messing me about unecessarily.
Consider this, if you pursue a claim with PayPal and they find in your favour she will get a strike against her, and you can still leave her negative feedback, contact eBay also, she had the wrong address details and may still not have corrected them so you might be able to get her account suspended for a while and as I understand it if ebay takes it in to their heads can put a seller through the mill asking them to provide a stack of documentation by post before they reactivate their account.
If you don't pursue it you will get nothing and you are left with a belt fit for the bin, so okay you may not get postage back but any money you recover is better in your pocket than hers and you get the satisfaction of making it a bigger problem for her than you, for all you know she pulls stunts like this regularly and you may be losing out because no one else bothered.0 -

Totally agree with the above- not being lazy but it makes a lot of sense.Are you aloud to conatct seller hinting you may take this further as she should have correct address listed etc and she may relent0 -
The problem is though if the buyer opens a not as described dispute and paypal find in her favour then she will only get a refund once she can provide proof it has been delivered back to the seller at there registered paypal address. As this is no longer the sellers real address this is going to be a problem so as I said earlier unless the seller sent to me by trackable delivery the first time I would open a not received to ensure I get my money back. I would wait until I had my refund before reporting them.0

The item was sent to me by recorded and there is a not as described dispute open but to be honest, I if it hadnt been sent recorded I still couldnt lie and say it hadnt arrived when it had. Call me niave but I like to do things by the book.
The seller has offered me £3.63 and to keep the belt but I dont want it and think the fairest way would be for her to give me the £6.70 I paid and then relist the item and I will send it to the new buyer . My first thought is that the seller has not been the greatest/friendliest communicator. Do you want to get involved in a 3-way transaction?
If so, get your refund before they resell, as otherwise you won't be able to file a PayPal claim once you no longer have the goods.0 -
If you open an item not received she will presumably still have the emails sent to her saying the belt is not as described. She could forward these to ebay to prove it was received.0

eBay don't normally accept personal e-mails as evidence, only communications that have went through 'My Messages' are normally accepted and it isn't necessary to forward these to eBay as they can access them directly from your account, these messages include replies to messages received via 'My Messages' sent from you own account.0

Has she really moved or has she just refused the item so she didn't have to refund....i would go along with others and do a dispute in a hope she gets a strike, cause as much hassle as possible and think your feedback carefully to let others know how bad she is
Good Luck....this would eat at me....I'd be sooooo rageful!!!!!!Never put off until tomorrow what you can avoid doing altogether.:D0
