So even if it has been passed to a debt agency I should still send a payment to Studio for the original amount?

    Thank you popsaw!

Sorry to be a pain in the behind but if I send a letter to them with the payment what should I say re the charges and OFT. I know there are templates around, any that would be suitable for my situation.

I think you need to get some advice and assistance from someone like the CAB on how to deal with this rather than relying on different posters advice here.

It could all escalate even further if you don't get all this nipped in the bud quickly.

    Thanks again.

I will send a cheque for the original amount and try and appeal to their better nature with something about the OFT and charges for late payment being deemed unfair.

Can someone tell me if this looks ok or needs amending. Thanks!

    Dear Sir/Madam
I have enclosed a cheque for £7.99, which is £2.99 for item purchased and £5.00 delivery charge.
It has been deemed unlawful by the OFT for companies such as yours to penalise people with hefty late charges fees so I am disputing the charges you have put on my account. And I do not believe these charges reflect the true cost to Studio.

Are you sure the extra charges you face are levied by Studio, and not the debt collectors?

Why not take all your documents (including the agreement with Studio) to the CAB and let them guide you - they will also assist with letter writing.

You may make things worse with this letter!

The charges have been added by Studio, £20 at a time.

I can't see how it can be any worse tbh with you, they either accept my letter or not. I do appreciate your advice.

In your original post you said you set this account up months ago, so there must be some charges you are due to pay.

Your letter doesn't acknowledge that, and you are making no attempt to pay them.

It can get worse if this all ends up with a ccj, bailiffs etc all over a £3 box of chocolates!

So, I will include interest charges! How much interest would you pay on a £2.99 purchase I wonder. I will find out from their site.

Like I said, they can either accept my letter or they can refuse and I would assume they would send me a letter stating this, if they refuse it then I will deal with it and pay it in full. They will not instruct bailiffs without first refusing my offer.
