Writen Statement Help

We have to people employed by ourselves, we never gave them a written statement when they started, but now wish to, one has been emplyed 5 yrs the other 10 months, we did it verbally which seemed ok at the time but the way the laws are changing in favour of the employed person we want to put it in writting, my question is do we back date it till the the time we employed them, or do we do it from the todays date?Any help would be much appreciated

    Is it a job description you want to give them, or a written statement of terms and conditions?

    A job description would reflect what they are actually doing now. A statement of terms and conditions would probably say something like "Your period of employment started on XXX " and that would be the date they started.

    OK, have a look at the ACAS site here for help with writing one, but there's also some stuff on BERR.

    To a certain extent you'll need to formalise whatever arrangements are now in place, I think, certainly for the employee who's been with you five years. These days you are supposed to give a written statement within 12 weeks of them starting. If you don't then certain assumptions are made, eg about the length of notice period.

    I would not, for example, try to radically change the number of hours to be worked each week or the times when these were to be worked.

    good luck! DS1 and DS2 have just been given their Written Statements, DS1 has only been there four years ... although in their cases they are very much casual workers! However when they started they very rarely got holiday pay (DS1 got some when the cinema was closed for refurbishment once), whereas DS2 was told he had to take 4.8 weeks paid leave last year!
