DLA renewal.

This is a strange one, I'm not sure anyone can help me but i'll ask anyway.

Back in April this year I see my doctor and CPN they ask me what I am claiming moneywise. So I let them know, My CPN suggested that I should put in a change of circumstance for DLA. I rung up and next day I had a form (I did think this was wiered as it arrived the very next day and DWP are not that quick usually!) I filled it out and sent it back. I Phoned DWP a few weeks later to see how things are going with my change of circs only to be told that I was due a renewal form and it was that I had filled out and not the change of circs as my DLA is/was up for renewal in October. I asked what I should do about the change of circs form because things are different from when I initally claimed DLA but the same as when I filled out the renewal a few weeks ago. Anyway the lady suggested I filled out the change of circs form because the renewal form wont take effect untill October anyway.

So today I phone DWP because it had been a few weeks since I sent off my change of circs form but I had no letter to say they had recieved it. I was told that my award has changed to high rate care but it wont take effect untill October and that my change of circs form had been disregarded. Does anyone know why this is?

I don't understand why it has worked this way? I thought if I got awarded a higher level of care it would take effect almost immeadiatly?

I'm sorry for the confusion of my post. I hope someone can read what i have wrote and understand.......

    Have just read the following in the Decision Makers Guide, and it seems that they are taking the qualifying period (QP) to be from now. If this is the correct interpretation, then the higher rate would start in October.
    Movement between rates
    61612 People may move between rates as their condition changes. A QP has to be
    completed before a higher rate of benefit becomes payable, but a change to a lower
    rate takes effect immediately, because the QP has already been satisfied. The DM
    should
    1. be aware that the condition of people with disabilities can change from day to
    day and

    2.
    take account of the needs over the QP rather than on a particular day.
    It does seem unfair that the lower rate kicks in immediately, but you have to wait for the higher rate. However, I can see how they justify it (though don't necessarily agree with it ;) ).

    Thanks DMG24 for taking time to answer my question. I have been looking on the internet for information but not found anything.

    I have been recieving DLA low mobility and low care now for nearly 2 years. My condition has been the same for about a year now I just didn't realise the change myself.

    Does this mean someone can be ill but you must wait a certain period of time before you qualify for what you qualify for anyway? LOL

    That doesn't mean much sense does it? I'm not very good at explaining myself

    What about carers allowence? can this not be paid to the carer either even tho they are caring for someone who eventually qualifys for higher rate care?

    How bizzare?!?!

    Anyway, Just incase anyone else is having the same problem I phoned DLA today and was told this.

    My renewal happed very quickly because I had handed in all my medical evidence so dispite someone telling me in a previous call that my renewal wasn't going to get touched untill August was not correct. Anyway thats out of the way now and has been done.

    My Change of circs however hasn't been sorted out yet and at the moment I am awaiting my file to return to the decision maker so that will be done also.(note that it hasn't been disregarded someone at DLA didn't read the notes correctly) I have gone past the qualifying period of 3 months so hopefully if the decision maker makes a decision in my favour it all will be sorted out soon.

    The Jist of it all is that with there being 2 claims in at once it has got confusing but all should be sorted by the end of next week :-)

  • hi wondering if anyone can help me with my problem. im currently on dla and income support, housing benefit and council tax benefit. i have a diagnosi of borderline personality disrorder. i am currently looking into going to university. would i still be entitled to these benefits if i went to university. i dont want to ring benefits as they ask for your ni number and might get funny. dont want to mess up my money as i still have issues. i cant seem to get any straight answers when i have searched it online. has anyone been in a similar situation. also i was made bankrupt 2 years ago. i have been discharged. if i went to uni would i be able to get student account with overdraft and credit card . can i anyone help.

    Hi confused,

    You would still be eligible for IS and DLA whilst a student, but some of your student income would be taken into account when assessing your income, so you would no longer get full IS and HB. However, your DLA would be unaffected, and you would receive a Council Tax exemption if you studied full time (and live alone).

    I doubt that you would be able to get a student account with overdraft and credit card, as these are credit checked.
