planning permission reapplication

on a refused planning application, how long does the applicant have to reapply with revised plans under the same application as it were?

    You can re-apply anytime.

    If it's a free-go you're after then 12 months from the date of the decision.

    Any applicant (not just the current one) can apply at any time. If the plans are in line with the Council's planning policies (see the Local Development Framework/Plan) then they'll be approved.

    Current plans that are refused could be revised in the future so that they are in line with the Council's policies and then get passed.

    If you're in an area earmarked for development, then you are unlikely to be able to prevent any development at all. The applicant only needs to submit plans that are in line with the policies in order to get their approval.

    There's some confusion here - you can't reapply "under the same application" - it has to be a completely fresh application, and as mentioned above, provided it's on the same site, for a similar development, by the same applicant, and within 12 months, then it's free.

    If you're submitting amended plans whilst a current application is still 'live', i.e. it hasn't yet been decided, and you're amending it in response to something the planning officer has said is unlikely to be approved, then obviously it has to be done during the course of the application, and it's down to the individual planning authority's discretion as to whether they accept it or not.

    I think from what others have said, "yes" - but there is nothing to stop them (or anyone else e.g. new owner) submitting a fresh application.

    What I'm trying to say is that there is no limit to the number of applications that can be made. The applicant can keep making applications until they "hit the right spot" - or a new applicant can submit an application that "hits the right spot".
