Should a tennant actually have to request the Gas Safety certificate?

Friends of my daughter are moving out of their flat after 2 years and 1 month. There was a certificate dated sometime in May 2006, but they got nothing after that. As inexperienced renters they did not realise there should be a new one each year, and the whole time they lived there nobody ever came to check anything (there was CH and gas hob and oven). The boiler was repaired once after being out of use for a month, but no paperwork left with them.

Now the LL is trying to withold their deposit because the white (!!!) sofa and chairs are a little grey now. Everything else is cleaner than when they moved in.

So we are trying to figure out if they have any leverage here to get her to return their money

is there an inventory which was signed on move in and on move out ? if not, then no deductions can be made.

i would write to the LL and ask for copies of the CORGI Landlords Gas Safety certificates for the past 2 years and ask for them in 7 days. if they are not forthcoming - i would then write a LETTER BEFORE ACTION and say if not received in 7 days you will issue proceedings against the LL for return of the deposit in full and that you will write to the HSE with regard to his criminal negligence with regard to lack of CORGI certs.

Each CORGI cert has three copies - one for LL one for tenant one for Gas engineer

Yes thats what we thought too. It had been on the market for a long time but he was refusing the low offers he got.
He's got lots of properties though and deals with asylum housing normally.

Would not have an up to date gas safety certificate make the tenancy null and void?

No

I doubt its mentioned in the contract, and even if it is, this probably isn't good enough reason to break the contract.

It is nothing to do with the contract it is a legal requirement, for a L/L not to have one is a criminal offence

It being a criminal offence isn't enough to void the contract though Its a separate issue.

No inventory.

They are waiting to see what she does, they have used all my upholstery shampoo to try and get the sofa clean, but are minded to report the lack of the gas certificate anyway as they had a lot of trouble with her over the last 2 years!

Every time something broke down, she asked them if they knew someone who could fix it for them, the inference being for nothing.
They had no CH for a month, on another occasion could not flush the toilet for several weeks, and the fridge/freezer kept going into melt-down and letting their food defrost. That still has not been fixed. The sink was loose in the worktop, and the bath seal leaked, letting water go down into the flat below.

I only just heard all this or I would have tried to help them sooner.

Is reporting her possible? Where would they go to do it? (Scotland)
