Worrying Letter From Capquest?
Legacy_user
I have been paying them through Payplan however they have never been happy and want more. I have told payplan about this etc and they said they would get in touch, Infact I have told them 3 times and Capquest actually phone me daily, I now just don't answer. Anyway today this http://img395.imageshack.us/img395/126/capquestna0.jpg letter arrived and I am worried. Capquest say apart from paying them the money Payplan have not been in contact with them.
What should I do? They are getting regular payments and have been for about 12 months but they have never been happy.

I can understand why it as upset you. Payplan should be contacted as soon as possible and send this letter to them. At the moment it is a threat (we will be on or around the 16th) It is a horrible threat at that. From what I have read statatury Demands are easy to defend but it is no good crossing the bridge until you get to the river, I hope you understand what I mean
I would consider writing to OFT explaining that you are paying through Payplan and that you have now received this letter
I am not going to say don't worry because if were me it wouldn't help, Have a cuppa and a few good chasers I find that this helps me more

Most stat demands are never followed through by creditors.
How much of a worry this one is to you depends on your situation. For example if you don't own property, don't own a car and aren't in a career that bankruptcy affects then their 'threat' might actually save you spending £495 on petitioning for bankruptcy yourself.
How much is the debt? Was it a credit card or what?0 -
Agree with above , we need more details please . Have you ever requested a true signed copy of your CCA ?0

I agree with the above posts - it would be good to know how much the debt is for and what your agreed monthly repayments are.
The threat of Bankruptcy is a very nasty one but as another poster has said it is very rarely followed through.
Keep us informed.0 -
More to the point if you are actually reducing your debts and obviously sticking to a repayment agreement then there is very little chance you will be made bankrupt if you contest it SHOULD it get to that stage...DFW Nerd #025DFW no more! Officially debt free 2017 - now joining the MFW's!

My DFW Diary - blah- mildly funny stuff about my journey0 -
Just wanted to bump this one to the top, sorry!!0

Just reading your post, is it correct then that if you are seen to be making regular payments and generally reducing your debts then Court's would look favourably on you if a creditor tried to force Bankruptcy?
I say this because I have around 20K of debt on around 7 or 8 credit cards and I've made payment plans with each of them and they all seem to be "happy" BUT Llloyds TSB have said when my current 6 month repayment plan ends they will insist I go back to full payments - which there is no way I could afford!
I wonder what tactic they will use then?0 -
bump to the top please!0

I requested my CCA with them. They are one of the creditors that have supplied a CCA. I owe them £1000 in total. And I do not own my own home/car etc,This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0

Does it look ok ? Everything in there ? You could try writing to them again explain your poor financial situation . Tell them one of your other creditors are threatening a SD and that as you have no asset , that you feel is my be your best solution . Explain that you do not know what position this will put their company in as they are way down the pecking order !0
