Hi,
I purchased a BMW 316i from a car company. The car was running fine and then after a week it kept cutting out. The car company told me to take it to a garage and they would pay for everything sorted.
I just heard back from the garage and they have replaced a few things and still cant solve the problem - the car runs fine then acts like its out of petrol.
The car is now being sent off to a BMW specialist - ive only had it a week and half and only been able to drive it four days. Does anyone know what legal stance i have on this as its very annoying - although it does look like the car company will be paying for everything it is still a maajor hassle. And am scared they might back out of agreeing to get everything sorted.
Thanks,
J

You would have been in a stronger position had your returned the car to the supplying garage and told them to get it sorted.
You have now taken it to a third party garage and the original supplying garage can say that the third party garage has caused some/all of the problems now being experienced. Hopefully the supplying garage are a reputable company and will not do that, but in that case why did they not take reponsibility and arrange the repairs/investigation themselves in the first place?
You need to reject the motor ASAP to ensure that you do not fall foul of the law which, if my memory recollects correctly, requires you to reject in a reasonable time. This has been held by the courts to be as little as a few days I believe!!! Otherwise reserve your position by requesting the suppling garage takes over reponsiblity for providing a car fit for for purpose and of reasonable quality and if they do not achieve that within a reasonable time you want a full refund.

It doesn't matter who they are. If they sell cars as part of their business they are reponsible under the Sale of Goods Act.
As I said you are in weak position as you should have made the seller sort the problem out. However, keep at them and do not let them fob you off they are responsible regardless of what they try and say and do.0 -
Hi all,
Thought I'd update you on this.
BMW took the car and fixed everything the other garage had fixed. Still hadnt sorted problem. Finally they found the problem to be a loose connection with crank shaft.
So now have car back!!!! Have noticed now that the rev counter doesnt move slowly up and down while car is idle so it must have fixed something.
Hope everything can just stay ok for a while now‘It ain’t over 'til it's over’0 -
