    Also speak to your Landlord who may be patient if you explain you are worrying about your Housing Benefit.

    Keep your chin up, things like this really aren't worth getting stressed out about in the long run :)

    thanks so much made me feel better .when i hear negative comments it really puts all the pressure on my head and gets alot worse i know wot im goin through and its a really bad time.i wish i could sort my life out properly which i am going to do very soon once this visa and jsa problem is sorted out if he gets sent back then thats really sad for my daughter then i guess i just got to go single parent and then when my daughter goes school i will get a full time job thats it.

    Hey listen, don't let people on here make you feel negative :)

    You have to presume they are nasty and spiteful to get their own kicks, and really couldn't care less about your situation :)

    What is your Sister like? At the age of 19, I am sure she could help you a little with Childcare. Is she working or claiming Benefits? Is she entitled to any HB to help you out with the rent situation?

    I know that you may not want to face the prospect of your husband being deported, but you really must face it - are you married or just together sorry?

    I would contact all the relevant departments to make another application for a VISA - even if he had to go back for a short time to apply again. What nationality is he?

    The fact that he has been here two years without any government help is a good thing :)

    I am sure once he gets his VISA sorted he will be able to get a job - he managed to get a NI number and I am sure there must be something he can do.

    It probably isn't all as complicated as you think - what skills does he have?

    You alone are entitled to benefits - I am not sure if this is complicated with you being married.

    I Found this:

    We would suggest that you send your application to the Home Office at least one month (but not more that two months) before your current visa expires.

    You must be able to show that you posted your application to arrive at the Home Office before your current visa expires, or if you are going in person to the Public Enquiry Office your appointment date must be before the date that your current visa expires.

    It is a criminal offence to stay in the UK longer than your visa allows. If you apply for your visa extension after your current visa has already expired, you will automatically lose your right to appeal should the Home Office decide to refuse you a visa extension.


    BUT he may not need to worry about appealing as he is married and has a Child here - surely they will take that into account?

    thankyou so much i know its wrong that his visa is expired and i shouldnt of delayed it but i was haveing ups and downs with him that way i just left it.i went pakistan to marry him with my own choice and applied for his visa from there we came to the u.k toghter and now his visa is expired he is pakistaani im british.and we have a daughter.

    Ah well it's done now and it's more important to get it undone :)

    Well you are married and have a child so are entitled to stay together somewhere...

    Plead your case with the British Embassy.. he has a more worthwhile reason to be here than most!

    In the English legal system, that (the highlighted text) is not true. Having a child is just one of numerous considerations that will be taken into account in deciding whether someone is granted leave to remain.

    They are married and can prove they are intimate and all the rest of it so they are entitled to live somewhere together, whether that be here or in Pakistan skint... then who knows, but they can't be forcibly separated. It's not like she's known him two minutes, married him to benefit him access to the Country is it?

    You people keep going on about and saying that haveing a daughter is not a good enough reason for his visa extention....how cruel can you get.But the actually thing is he would 80% be able to get the visa and 20% probaly not and most defentely becoz of his income. the thing which worrys me the most is that its been expired for 6 months thats it.even though i know some people do it for years and some win soe dont and they are just 6 month visists without marriage.where as i was married to him b4 he came to the u.k
    this is wot i found on a u.k visa website

    Your application may be refused and you may be banned from coming to the UK for 10 years if you use a false document, lie or withhold relevant information. You may also be banned if you have breached immigration laws in the UK.

    this is wot worrys me the most.so its like a kneck to kneck
    chance so its like 50/50 just need good luck which i can see i wont get from here....propably becoz my backgrounds pakistanni
