OR Interview later on

Hi guys,

Have my OR interview soon, and am pretty cool about it. Just have a couple of questions:

- What's the worst that they could do to you? Can you even go to prison/jail these days for anything (Heard that you can't anymore)? I spent a lot of my debt on necessities like food, clothing, transport costs etc, but also had a little gamble here and there (Around £100 max total) out of the £34k debt, as well as spending probably £1k on other things over 3 years. A little worried about that, but not too much.

- How long does a normal OR interview last?

- What kind of questions can I expect? I've heard they ask things like why the debt even came about? Income? When you could not afford to pay for the debt anymore? Anything else?

Just want to be prepared. :)

    Worst they can do is slap you with a Bankruptcy Order for upto 15 years, and a Payment order for upto 70% of your excess income for 3 years.

    dont know what they ask still waiting for mine, but I expect all interviews are different as peoples circumstances are different.

  • They will look at your forms and ask you when and why you took out loans,credit cards etc and what the money was spent on. The same will og for your I&E form they will question anything they think is high or not allowed and tell you.

    My interview lasted about 90 minutes. have the forms out infront of you some you can see what you put down etc when the OR ask questions about it.

I spent a lot of my debt on necessities like food, clothing, transport costs etc, but also had a little gamble here and there (Around £100 max total) I put about a hundred on my SoA and said it was for the lottery etc and my OR said that was fine, if i'd got myself into debt by gambling it was a different matter but just putting a few quid on the lottery etc isn't a problem out of the £34k debt, as well as spending probably £1k on other things over 3 years. A little worried about that, but not too much.

    - How long does a normal OR interview last? anything from 20 mins to a couple of hours, depending how complex your case is (mine was about 30 mins and its a simple one)

    - What kind of questions can I expect? I've heard they ask things like why the debt even came about? Income? When you could not afford to pay for the debt anymore? Anything else? Mine went through my SoA asking me to explain parts of it, like what did I spend it on etc .. as i said mine was easy though as no new debt from over two years previous.
    He/she will go through your I&E as well.

    Answered a few bits there, just from what happened to me though!

    Don;t waffle .. if its on the phone there will be quiet moments as the OR has to write everything down.. don;t try to fill them by talking :)

    As Waspeze says don't try to fill in any gaps. Just wait to be asked and just answer as honestly as you can. Have a drink with you as well. It gives you something to do when waiting and you will probably find you get a dry throat. Write a list of questions you want to ask the OR and have your I&E with you as suggested by oneandonlyboy.

    If you think you will be prone to waffling put a note up in front of you.

    Thanks for all your replies, they've been extremely helpful. :)

    The interview will be tomorrow morning, so I'm hoping it goes well. I'll probably make a thread detailing everything that has happened so far in relation to why I even started bankruptcy proceedings, what happened at the high court when I went to apply etc, so that others in the same position will know what to expect. I'll make it after the interview tomorrow.

    Hi guys,

    Well, I had my interview this morning, and am relieved it's over. People who have already gone through this were right - The chap was nice, but probed every detail of my affairs. Most my answers were: "Not sure", or "Don't remember much about why that debt came about", but it was okay. At the end, I asked about BRO's and he said that they are reserved for people who were reckless and spending beyond their means. He said that what he can tell me is that it appears as though I probably was spending beyond my means, and was probably reckless judging by the info given so far.

    I'm speechless, lol. Now, I'm not sure what's going to happen. I couldn't remember where the debt had gone, only remember the essentials such as food, clothing, and all the usual stuff, but not sure at all where the rest went. I'm really hoping I don't get slapped with a BRO. Can it get any worse than a BRO though for recklessness?

    In any case, glad it's over. :)
