Urgent Help Please - Horrible Bailiff Will Be Back

Options
Hello - please could anyone advise me?

had 2 Parking tickets from a London Borough. Wrote to explain extenuating circumstances (1.had blue badge displayed when ticket stated i did not) (2.had stopped just outside the disabled bay as had an emergency with my autistic son) - these appeals were disallowed.

made representations to the court for one charge and I admit, got muddled with the second.

later had letters from the bailiffs, i wrote back to them and expained the situation that i was appealing and they greed to freeze the case as it was in dispute.

i contacted my MP who is looking into it also.

yesterday, i had a call about a family emergency, I called 999 for an ambulance and ran out to my car to get to my parents home.

standing near my car was a man. i opened the door and he said he was a bailiff after the money for the tickets. i explained my emergency and said the tickets were in dispute and i was actively trying to get a resolution. i go in my car and he got in his.....

i began to reverse to get out.he was parked fairly close so i had to edge out anyway - he then drove right up to my bumper so I couldnt get out!

In driving back I literally nudged his van. He jumped out aggresively an said I had rammed his vehicle...

i was desperate to get to my parents and begged him to follow me and we could discuss it - but he wouldnt move, he was abusive.

i sat in my car and called the police.i was distraught on the phone and the oerator stayed on the line until the policeman arrived.

he wanted to take my £400 car. the 2 x £50 charges have been pumped up to £1500!!!

the police said it was a civil matter and tried to reason with him to come another day.there was no chance of discussion with him, he wanted full payment. it was saturday so i could not call the court or CAB etc.

the day before i had emailed the court who had attached the forms for extra time to appeal.

i am planning to try and sort this out tomorrow as the compromise was that he is returning at noon.

please help - my vehicle is for my 3 disabled children (they have dsabled badge) and the 2 x tickets are (1 in my husbands name and 1 in mine) the car is registered in my husbands name.

i want to complain about the bailiff also. even when the police had left and he was supposed to be moving he sat for ages in the car stopping me getting out to my absolutely genuine emergency. this all took an hour.

DK what borough are you in? Found this but it applies to Bedford:

    The Disabled

The term disabled can cover a variety of conditions ranging in severity
from a bad back to permanent disability. Regardless of severity, THE
BAILIFF should never remove or levy on goods that are necessary to that
person by virtue of their disability. If it is evident that THE DEBTOR has
a disability that is anything other than a relatively minor disability, no
action should be taken without consulting BEDFORD BOROUGH
    COUNCIL.
These are from the guidelines set out by bedfordshire here: http://www.bedford.gov.uk/GetResource.aspx?file=bailiffs%20code.pdf

Have a look and see if you can find similar for where you live... at least until you have finished the appeals process...

  • a little bump, smaller than the one the baillif gave you!
I don't know anything about baillifs other than you're not meant to let them into your house. Lots of people on this board are experts though and will be along soon.

You should start a new topic...

Why do you need the car?

Generally you can only keep the car if it is required to get to your place of work, or you are disabled in some way that means it is necessary for your care. If they have not said they will take the car/levy on it, move it away somewhere else.

Bailiffs won't reduce the cost, you need to talk directly to whoever issued the tickets, i.e. the local brough and state due to ill health you have been unable to deal with these. But it may not be possible to reduce them as fees have been added for having to send bailiffs for non-payment.

Dark Convict is correct there is no point whatsoever in discussing anything with the Bailiff. You will need to speak with the authority that issued the tickets. Is there any chance your doctor could write a letter confirming your ill health? Disability Law protects you and the authority cannot be seen to be discriminating. Meanwhile park your car several streets away until the matter has been dealt with.
