disabled driver gets parking ticket help

:mad: hi my partner and i went to gloucester this afternoon to pick a tv up we parked in a disabled parking space[partner is disabled] we had badge showing come out of shop and a parking attentant was taking a photo of the car , and handed the ticket to partner partner refused ticket attentant was one of these new council workers
we were in only parked for 15 minutes we only had badge showing and not the clock that goes with it will we have to go to court? anyone got any advice thanks

    TBH, I doubt they'd enforce it. The clock is more for parking on double yellows than in a bay.
    Its a fine issued by the council and it costs nothing to challenge it with the adjuducation officer other than your time. The photo will show the badge was in the window so that goes in your favour.

    When you get your blue badge, the info leaflet with it says that you have to have both the badge and the clock showing, not just one or other, therefore i would guess that the council is within their rights to fine you because you didn't follow the rules :confused:

    Technically, yes, if you park in a disabled bay that has a time limit, you should be displaying your badge and clock. This is a habit we have got into; there are times when you don't need the clock but it's safest to display both at all times and most badge wallets have a convenient space for the clock also.

    I'm sure, if you write a nice letter explaining, they will let you off.

    You have to go through the system before getting to the adjudication officer.

    First, if you decide you want to challenge it, they may have two arguments against you:

    1) The incorrect permit display (which the photo will confirm).

    You will be able to add information about this regarding why you didn't set your clock

    2) Your refusing to accept the ticket.

    You may have to explain that.

    You need to send in the challenge within 14 days (in case you lose). If you lose the challenge and decide to pay, you get 14 days to pay at the reduced rate.

    But if you send in your challenge after 14 days and lose, then you have to pay the higher charge. (Double the reduced rate).

    If you lose the challenge and want to fight on, then you await the formal "notice to owner"

    That allows you a formal challenge. If you lose that you get the opportunity for a final appeal to the adjudicator.

    As they have "decriminalised" parking there, there is no question of you ending up in the magistrates court.

    Though if you lose your challenges and still refuse to pay, then there is the possibility of them taking you to the county court over the unpaid bill.
