    The good people are telling you to not sign it because it's not unheard of that SOME (not all!) creditors and particularly DCAs will actually forge your signature on the CCA once they have a copy of it on your letter... Hence you NEVER EVER EVER sign paperwork that you send to a creditor or DCA... if need be then write your name in capitals and should they try to claim that is your signature then laugh really loudly at them and point out that fraud carries severe penalties in this country :)

  • I take your point but surely the creditor would have to produce the original document with the signature in ink for it to be enforceable anyway.
    Also I would be interested to know whether people on the forum here have been able to identify unenforceable agreements and challenge them successfully

    With regard to the signature thing - just initial it or print your name I think is the advice.

    Now would the fee paying company that you are thinking of using, give you the information that the peeps on here have already given you? I think not. They are just after your dosh, keep it in your pocket and let good people here help you for FREE.

    Sorry to disagree, the major financial institutions in this country survive and prosper for one reason and one reason only-they shaft people at every opportunity and have a vested interest in encouraging as many people as possible to take on debt,aided and abbetted by the corrupt unelected government.
    I for one have no problem whatsoever in using any means at my disposal to shaft them back given half the chance

    Tell you what... why not start with asking them for a copy of the DCA before worrying about if it's "legal" in it's wording? :)
    I can assure you that those cowboy outfits can't provide you anything that people on here can't too. Although I have to say I'd start by posting a FULL SOA of all your debts, income and expenditure and look at what you need to repay. The right approach is to pay what you owe, IF you can get off on a technicallity then whooptidoo for you... but please don't take the approach that this is the way to deal with debts...

    And the likelyhood of a debt being unenforcable on a technicality depends on what the debt was for. Was it a loan? Credit card? Something else?

    You'll find a LOT of people on here won't appriciate that kind of attitude as most of us have and still struggle to pay back what we owe on the premise that more than likely we BORROWED money. That means at some point giving it back...
    I'll fight them every step of the way about unfair charges and if you have reached a point where you can't pay for things like food/heating/housing then yup I agree that debts come last in the line - but so far that's not the feeling I'm getting that you want?
    WHy not post an SOA and let's see if you can afford to pay this back and what the best route is for you to deal with your debt?
