i have paid the debt yes, it was just that i saw posts saying about DCA's not bein able to enforce debt without a CCA ? and was :mad: that i had paid these ppl with loads of their charges as i was panicked and upset by the constant calls and didnt understand all the legalities etc- stil dont ! lol....all your replies have been helpful tho thank you !!! really appreciated honestly! its prob me not explaining properly:o0

Sorry had to go sort/eat dinner... if you've paid it then I think ther eis very little you can do about getting any money back. If you had defended it at the CCJ stage then maybe again it could have been changed. Personally I've not heard of anyone overturning the CCJ AFTER it's been paid off...
I don't pretend to knwo it all by any means! But the longer you hang out with this crowd the more you'll learn
And just because I haven't heard of it happening doesn't mean it hasn't or indeed might in the future

Hi, is this an actual CCJ you have or was it a letter froma DCA saying you had a CCJ. Summonses dont usually come in the colour of blue that i know of. An i have had plenty. Who are you paying the money to hun. Have you checked with the courts you have a CCJ. Sorry just a little confused about things. The ccj will not be wiped off altogether from your credit history. It will be marked as satisfied. It will still be on your file for 6 yrs. Usually if you get a ccj it is the original creditor that takes you to court. Who slapped the CCJ on you. County Court summonses, for debt, always used to be blue. Years ago I knew what I was talking about but now my info may be out of date so please check.
Have you contacted the County Court and asked whether you have a CCJ?
If yes, do their records show that it has been paid?
If it is paid within 28 days of judgement and you can prove it with a letter from the creditor or their solicitors that are shown as acting on the court record, or if you can show a receipt that clearly shows that it is linked to the CCJ then you can ask for a Certificate of Cancellation from the County Court. There is a fee (used to be £5) and then the record of the CCJ is removed. (if paid later than 28 days it can be marked satisfied but not removed and will stay on record for 6 years)
If you had not received the summons but judgement was still entered against you then you could apply to set aside the judgement, which would also get the CCJ record removed, but would cost a good deal more.
Not sure about the CCA, but if you have a judgement against you then they can pursue that judgment, regardless of other stuff, because in theory (nice theory) if you did not owe the money then you could have defended the judgement, and if you didn't receive the summons then you can apply to set aside the judgement (last I heard cost £75) and then defend the matter.
FWIW if I owed the money I would accept that it had to be paid and get the Certificate of Cancellation (also known erroneously sometimes as Certificate of Satisfaction). But you know your own circumstances best. HTH Always another chapter0 -

firstly i dint receive any initial forms that Howard cohen and co supposedly sent me - they tell me its blue?? but i did move house and they tell me they were sent to the prev address....when i asked for a copy cos never had anythin like this b4 i 100% didnt have a clue what they were talking about!!! wa told only one copy of these 'claim forms'?! were ever sent and it was tough, i owed money....had to pay in 3 payments - over £900 a month x3....this was over the phone....
was extremely distressed at the time - like lots of u say - its fear of unknown - if i had known then what i no now i would have defended and all the rest of it thats why i am sooooo mad at these horrid ppl at DCA Cl finance and Howard cohen......etc
i have now paid in full i paid money march, didnt have enough april and third payment was due end of may -i got a 'in default' letter saying judgement had to be paid within one month ....rang and provided i paid 7th june - so i can have this removed when i send receipt that has arrived this morning ;o) to say paid in full etc within one month - apparently judgement entered 19th may so i paid in one month....can have it cancelled
but there are so many charges and late fees etc - mad that i have paid all of these and i know some ppl on here will think either tough get over it or that i am dippy but feels like i wasnt myself for 4months....and i just did as these vile ppl demanded.

think its just a case of i am mad at doing what these ppl have some what forced me to do because i dint know or understand the situation...i did owe some money but would say best part of about 600 will be fees and charges if not bit more!....just wondered if there was ANYTHING more i could do....to settle my madness lol ;0)
