CCA reply NDR/Littlewoods - What now?

    They will probably sell your debt on to someone like Phoenix and then you will have the same argument with them.

    Does their 30 days start from when I sent the 2nd letter to them regarding this. Obviously they replied before the 12+2 was up.

    I think its a common trick to sell on unenforceable debt.

    If the debt is sold on to another DCA, you can complain to your local Trading Standards and the OFT. If it's unenforceable they can't make you pay, so good luck.

    So what should I do about the one I got from Bank of Scotland today? Basically its a letter saying:

    "Dear Miss XXXX

    Thank you for your statutory request for information with respect to the above agreement.

    Enclosed is a copy of the executed agreement.

    As at the date on this letter:
    (1) The balance on the account is £1796.61
    (2) The balance limit is £1500
    (3) The current interest rates are 20.83% per annum for purchases, 20.83% per annum for balance transfers, 20% for cheques and 20% for cash advances (19.9% APR)
    (4) The arrears on the account are £141.21
    (5) The amount currently payable by you to reach us by $th July is £36.03
    (6) Further payments will be payable each month at the rate of 2% of the balnce outstanding or £5, whichever is more.

    Please note that the information we have provided you with is all the information we are required to provide you with Under Section 78 of the Consumer Credit Act.

    Yours faithfully


    Blah blah blah


    And they have sent me a recent copy of the Credit Card Agreement, unsigned, and a signed copy of the original application form and not the CCA(with no credit amount, no repayment amounts, no interest rates and illegable terms and conditions)


    Where do I stand with this one then?

    A quick thought, seeing that NDR have added charges (as well as Littlewoods adding charges) to the account, if they cannot come up with a signed CCA by the time the 12+2+30 is up can I claim back any charges I have paid. PLUS what about any defaults that they may have put on my Credit reference files (which I am still trying to work out how to get as I only have a solo card and cannot pay for online).

    If they can't produce the CCA and the debt is unenforceable, I don't think you could claim back charges also. It needs to be one route or another.
