Who can witness a will?
A beneficiary cannot witness a will. If the beneficiaries are the children -all of who are married then can the spouses witness the will or not or the children of the beneficiaries if they are over 18? The only listed beneficiaries will be the children.

IHT and Property
The ongoing saga with the will that I am a beneficiary from ! This doesn't effect me but impacts on a fellow beneficiary and I am trying to support her at the moment. She is the partner of the gentleman who died. No marriage or civil partnership. The total amount of the will is in excess of £1million. There are two…

Fathers Pension but no beneficiary named
Hi guys, am getting confused in relation to my late fathers pension. He recently passed away without a will and was not married to my mother, so his estate is now going through probate. We discovered he had a private pension from his younger years and am not sure if this will be included in the total value of this estate.…

Useless gift tapering
I had always assumed that you could use up your tax free threshold on assets that were to be taxed at the maximum 40%, but I've now come across this example on gov.uk that suggests you have to use it on the lowest taxed items first: Is this correct? If so, doesn't it mean that tapering is practically useless for most…

DWP Overpayment request/Liability
Hi everyone, I am hoping that someone could answer a question which is causing my 80 year father a lot of distress. My grandma died back in Apr, we have done the probate and have received a letter from the DWP asking for various financial information to check that she was not being overpaid for, presumably, her pension…

Help! What happens if someone dies before first insurance payment was made?
This is a very serious question, because it's true. My wife and I took out a joint life insurance policy some time ago. However, 5 days after the policy was signed and prior to the first payment being processed - she was killed in a car accident. The insurance company refused to pay out because there was no initial monthly…

Wills, keeping it in the family
We currently have a pair of mirror wills that leave the entire estate to the other spouse and then equal division between our children on second death. Can we add that, should the survivor remarry, the deceased's half of the estate still eventually gets divided between the children and cannot be passed to a second spouse?…

Codicil?
My brother went Bankrupt in June 2019. My question relates to my mum's will. She is only 72 and is unlikely to be going anywhere soon however her Will currently names both myself and brother as beneficiaries (of a very small estate). If she were to pass away before my brother is discharged, would the OR take any money to…

Conditional Wills
I have recently been speaking to my father and he has asked me to be the executive of his will. He is currently in good health and recently retired and therefore isn’t planning on going anywhere just yet! I am the youngest of three children and his original plans were always to split his estate evenly. In recent times…

The Penalty for Dying Childless (No Main Residence Allowance).
OH and I are in the process of drafting new Wills. We will use a (STEP) solicitor but in the interim are discussing options that we believe could fulfil our wishes without incurring IHT. I am childless so am unable to claim the main residence IHT allowance. My major beneficiaries will include my brother and his two…

Question about Lasting Power of Attorney
Sorry if this is in the wrong forum as couldn't spot a more appropriate one! My parents have set up financial LPA's, naming myself and sister and these are all signed and approved. If we ever get to the point of having to step in and look after their affairs do we have to go through another step to "register" the LPA…

Rules of Intestacy - Estranged wife?
My partner's father died suddenly earlier this month without leaving a valid will. There was one but it has been lost so another was written but never witnessed so I'm guessing it's not valid. There are also emails from him (to my partner) stating what his wishes are after his death. However, the confusing matter is that…

Dealing with the assets, savings & investmeents of a family member who has died abroad
Good evening, This is a morbid subject but it is something that has to be dealt with when the time comes. My mother is 74 so she is at the age now where she is very vulnerable to the ailments that come with old age. She is currently abroad enjoying her holiday and I hope to see her in two weeks when she is back. Were the…

Don't Use Cardiff Probate Office - Absolutely Hopeless!!!
Sent my application in for probate beginning of August. Had brief email from them soon after to say they have received it. Still waiting for probate. I applied in middle of summer, now winter - 13 weeks later!! The inheritance tax was fully paid 2 months ago, and HMRC said they sent the IHT421 proof of payment at the time…

Re title register
Hi Guys, I have opted on savings and investments for advice on wills and IHT. Put on to this site. This was one reply. As said, no IHT no matter how much you own/leave to each other. You say house in joint names but check it's joint tenants not tenants in common. You can do this by checking the Title Register, if it's held…

R185
Is an R185 form only necessary for the beneficiaries when there is income from the estate that has been paid out to them in a tax year? So if no payments of income have been made no R185 is needed? Are payments from capital ok? Probate has been granted and an estate tax return completed. Tax has been agreed and will be…
