    As you are currently claiming HB and if you are moving to a new property within your local authority. Then this is not a change of circumstances which will trigger the need for a new UC claim.

    Thanks for your replys .

    I am not currently moving from my home , although I now have 1 room too many , I also need assistance throughout the night on occasions ( maybe 2/3 nights a week ) so this will enable my carer to stay on such occasions as my son isn't here to assist anymore . I will of course just pay the top up of bedroom tax .

    I was worried that him moving out would change my housing benefit claim over to universal credit but it doesn't as I am still in receipt of housing benefit ... just not the full amount any more .

    There are no changes to my disability or my needs other then the carer now having to stay over sometimes

    Many thanks for your help in all this , you really did help to calm me down from a hyperventilating emotional rollercoaster

    I assume you're talking about the bedroom tax with your carer using the spare room now your son has moved out? You will need to see about claiming a DHP Discretionary housing payment for this. Contact your local council for a form and they'll decide from there if they'll pay it. Don't hold your hopes up! It does also depend on the funding your local council have also.

    As for UC if you change over when you asked to then your extra payments on top of your ESA will be protected but if you change over because of a change of circumstances then you'll lose the extra payments.



    I am presuming you are living in social housing as you are referring to the bedroom tax.

    You should not have to apply for a Discretionary Housing Payment to help with the 'bedroom tax'.

    You should be allowed the extra bedroom if a non resident carer is regularly caring for you.

    You need to contact your local council (HB) and tell them your son has moved out and you require an extra bedroom for a non resident carer. They will tell you what evidence you need to provide for this.

    Thanks for your reply this helps enormously .

    I looked at the link you shared and it says that they need evidence that I am on pip enhanced daily living .

    They should already have a copy of this as I receive housing benefit .

    I have emailed them and explained the situation and asked how I go about it . Many many thanks again for your advice
