Credit File Correction

2 years ago I received a consent order when i divorced my Ex husband which stated he had to pay any and all joint debt that was accrued when we were together, due to him maxing out overdrafts gambling and paying back payday loans.
At the time he was working for a reputable bank which held the larger of the two accounts (2k overdrawn) and we went to the back to get my name taken off the account but the bank refused - saying the consent order didn't mean anything - i believe this was due to him working for them and the adviser we saw being his friend.
I was wondering if there was anyway to challenge this by getting in touch with the financial ombudsman and/or getting a correction on my credit score, as the tiny amount he is paying off every month (if he pays anything at all) is crippling my score and i am desperate to buy a house - something i am unable to do if this carries on.

    You won't be able to get it removed, as it is a joint debt.

    See a broker when it comes to getting a mortgage. You score is irrelevant, but you're going to need to review your files in detail.

    so the consent order which states its to be made a singular account means nothing? i was hoping for better news if i'm honest. its probably worth me saying i never signed anything for this joint account - he forged my signature but i cant prove it.

    The consent order is just an agreement between the two of you.

    It doesn't change the original agreement with the lender.

    What does your Consent Order actually state about the debts?

    From what I understand this simply divides any assets, outlines any maintenance payments to be made and provisioning of debts.

    I don't think it actually removes your liability to repay the debt, it's just an agreement between you and him, should he at a later date, try to state debt XYZ wasn't wracked up by him or vice versa.

    it states that he must "endeavor" to take my name off the joint accounts as they are to solely be his.
    Tthe smug look he and his work mate gave me when she said 'all endeavor means is 'try' and this meeting classes as him trying, but we say no. well that broke me to tell you the truth. he didn't try, it was just another opportunity to break my spirit.

    He did try.

    He asked them, they said no, which is exactly what they would be expected to say.

    There's nothing he can do to force them to remove your name from the account when there's a debt.

    Step 1: Obtain copies of all 3 of your credit reports.

    The free versions to check your credit files are below:
    Experian: https://www.moneysavingexpert.com/creditclub
    Call Credit: https://www.noddle.co.uk
    Equifax: https://www.clearscore.com

    Step 2: Report ID theft to police in order to obtain a crime reference number:
    http://www.actionfraud.police.uk/fraud_protection/identity_fraud

    Step 3: Write to all lenders on your files who your ex has taken out accounts in your name that you don't recognise and inform them that:

    a) the account was taken out fraudulently by ID theft

    b) supply them with the crime reference number so that they know you have reported it to the police and if they need to pursue costs they know who to contact

    c) Ask them to remove the accounts from all 3 of your credit files and to confirm this in writing once it has been done

    Step 4: Sign up for CIFAS protective registration to prevent your ex in case he turns spiteful from doing this again in the future.

    I don!!!8217;t believe they were saying the account was opened fraudulently, rather if they can!!!8217;t get their name taken off by asking, they!!!8217;ll claim that they the accounts were opened without their consent.

    If it!!!8217;s the latter they could end up in very hot water indeed. Their ex appears to be relishing in dragging the OP down with him, if he finds out she!!!8217;s committing a crime to get her name off the accounts he!!!8217;ll be falling over himself to hand any and all evidence to the police to get her charged.

    And it!!!8217;s likely there will at least be enough from just the divorce proceedings for questions to be asked.

    Edit: For some reason all the apostrophes are messed up, again.
