    A spokesperson confirmed Emirates will not be trying to appeal the decision any further.
    She said: "We are very disappointed by the Supreme Court's ruling denying us leave to appeal against the earlier judgement of the High Court in relation to the application of Regulation EC261 to flights of non-community carriers originating outside of the EU .
    "As one of the world's largest airlines, we always comply with all legal requirements and based on the judgement, we'll advise customers of our approach in due course."


    So does that mean they will contact all passengers affected by this since 2005? I suspect not......

    Hi,

    I hope you can advise.

    My parents Non-EU Emirates flight was delayed.

    Departed from Birmingham at 2pm, landed in Dubai around 1am. Departure should have been around 3.50am but it was not departed until 10am in the morning. Meaning flight was delayed by 6 hours.

    The flight was from Dubai to Pakistan. My parents are elderly over 70 and had to wait long time without much support.

    Can they claim compensation? and how?

    All depends. Was the flight from Birmingham to Pakistan all on one ticket? What was the original time that the flight should have landed in Pakistan? and what time did it actually arrive in Pakistan? What was the reason for the delay on Dubai? Although Emirates is a non eu airline it took off from an eu airport so is covered by regulations even if the delay was in Dubai. If it was one ticket and it landed in Pakistan over 3 hours later than the original time it should have landed and the delay was not an extraordinary circumstance they are probably due compensation. Put their flight details into EuClaim and bottonline and see what they say. Also google and download Vaubans guide that's your bible.

    my incoming emirates flight was delayed for about 24 hours, i did complain to emirates at the time however they sent me following letter which i thought was not relevant as they stated they are not members of ADR

    Incoming flights on non-EU carriers do not qualify for EU flight delay/cancellation compensation. Some airlines give vouchers or other forms of compensation for delays, if you complain, but not Emirates.

    Your post makes no sense please layout the details and whether your flight was cancelled or delayed. Which airport were you due to fly from and to where were you flying to. Was the aircraft you were supposed to fly on delayed getting to you if so what reason was given. It will be easy enough to trace your flight with a few more details.

    i beleive there was a new ruling last year that emirates had lost a court case
    Thousands of passengers could be entitled to compensation for missed flight connections with Emirates thanks to a CAA ruling.

    So, what's happened?

    Back in February 2017, the Civil Aviation Authority (CAA) demanded that five major non-EU airlines (American Airlines, Emirates, Etihad, Singapore Airlines and Turkish Airlines) were to pay compensation for delayed flights that travellers are legally entitled to.
    Under EU rules, travellers are allowed to request compensation if they arrive at their final destination over three hours late as long as the delay wasn't caused by extraordinary circumstances - this includes flights with connections. It doesn't matter where in the world you're off too as long as you depart from an EU airport.
    Four airlines complied whereas Emirates took their case to the Court of Appeal in October 2017 and to the Supreme Court in an attempt to appeal the decision but ultimately their request was refused.

    returning from islamabad to manchester,
    flight was cancelled/delayed to next day, went to airport and had to return next day to fly back.
    just told to return next day ,no reason given
