    Ha! So when is Thomson going to offer some pathetic sound bite response to this article? Perhaps they will continue to defend their two year limitation lies designed to fob off customers?

    The difficulties people are experiencing in getting the cash that is rightfully theirs is really showing the airlines and travel companies for what they are.

    For any of those in the bottom statistics how dare you say you "care about" your customers. You don't give a stuff.

    I have experienced nothing but obstacles and hassle and lies from Thomson. Lies about being limited to two years to claim to lies about Extraordinary Circumstances.

    So where is the CAA in all this?

    There is no terminology for them to get out of paying as long as the delay isn't extraordinary circumstances.

    They simply just don't want to pay ANY claims for this. Clearly they value profit lines over customer care.

    The flight delays link in this story takes people to a page that doesn't exist error message from the site. Not really a surprise that a link like (h t t p removed) ://www.moneysavingexpert.com/news/travel/2013/08/www.moneysavingexpert.com/flightdelays doesn't work properly. This is the correct link to the flight delays article.

    that they can claim back to 2005 escapes me. It's simply not possible.

    I put a claim with Thomas Cook which got rejected today :(

    My Thomas Cook flight TCX127 on 1st July 2013 from Sanford to Manchester was delayed a total of 3 hours 23 minutes at Sanford. Expected departure was 16:50pm but did not leave Sanford till 20:13.

    It appears since the flight made up its time in the air it only got delayed by 2 hours 35 minutes from the expected time of arrival so they advised my claim does not satisfy EC regulation 261\2004, kind of annoying as I did have to buy food whilst at the airport due to the delay so was hoping to at least get something back.

    compensation is not due as the arrival time was under the 3 hours. You should be able to claim reimbursement of the food at the airport assuming that you were not offered anything by them. Send in copies of your receipts and reference their duty of care
  • Further to recent articles on flight cancellations/ delay I fail to see how the new guidance can help matters. Under unexplained flight safety shortcomings there is a section 26 that basically says any other technical reason is an extraordinary circumstance. This in effect is a catch all get out for the airlines who continually quote extraordinary circumstances. I believe ec261/2004 was judged on because far too many airlines claim these circumstances. I have a letter from the CAA stating it appears you have a case under ec261/2004 and referred it back to Flybe, who are now citing number 25 and 26 of the new guidelines in order not to pay the claim. Has anyone actually been to court since the printing of the new guidelines? And if so what was the result?
  • Why do Thomas Cook & the CAA keep reasons for flight delays a secret? Are we expected to accept that delays are due to "exceptional circumstances" without actually knowing what these are? I don't trust either of them!
