    Hi,

Since leaving school in late 2006, my son has had a varied number of temp type jobs, and a couple that should have been more long term.
But because he hasn't worked continuously for two years he hasn't paid enough NI. For the majority of the time he worked part-time for halsfords and behind the bar in a club.

He is a qualified level 3 city and guilds mechanic.
The reason for going into writing is i believe he should be entitled to something from the government, but i don't know what its called. I did speak to someone at the JSA when they wrote to him saying that he wasn't entitled to job seeker allowance, they then said he should fill out a JSA3 form. But i still think its so long winded to get any money its been 10 weeks so far, no end in sight.

Can I ask why you are speaking "to the JSA" when your son left school in 2006 and therefore must be in his 20s now?

I just dont think they've been very helpful, they should have known that he wasn't entitled - if they had bothered to check his file.

He would only be entitled to JSA C - which was HIS choice to apply for that or JSA C&IB- if he was employed and earned £5400 in both tax years 10/11 & 11/12

The Jobcentre can't just "look at his file" and see how much he has earned, that has to be done by someone in the claim processing centre who has access to HMRC records as part of processing his claim which can take 3 weeks.

It's his own fault for claiming "JSA C only" without asking someone whether he would be better claiming JSA C&IB to start off with.

Now he has been given correct advice that he should use a JSA3 to check eligibility for JSA IB. If he thinks there are too many questions to answer on the form to get help from the government then he has to option to throw the form in the recycling.

If he thinks he did earn £5400 or more in both those tax years and it was employed work "on the books" then he should collect all his P60 from the various jobs and send them to JSA to challenge the disallowance of JSA C.

What's this file? You're not seriously thinking someone goes into a job centre - seemingly for the first time in their young life - and there's a file on them are you?

I was watching "Waiting Time" with John Thaw the other day. The chap from MI5 said "It's in 'his file' "
Other guy says "Oh, so he has 'a file'? "
    MI5 guy says "doesn't everyone?"

I think the OP thinks that the government has files on everyone and everyone in every government department has access to all the information on that person. easily and quickly at the touch of a button. The concepts of "data protection", "need-to-know" & "authorised access" don't seem to have registered.

I'm sorry but this struck me as a troll post. Why one earth would anyone in their 20's looking for work have their mother or father sorting stuff out for them. Why on earth would someone who is looking for work and so trying to prove they have ability and common sense not research what they were claiming first to ensure they claimed the correct benefit in the first place JSA(IB) rather than JSA(C) only!! The jobcentre do not have "files" ready prepared for everybody just incase they may claim a benefit.
Debt free = December 2010...as of March 2006 it is now January 2010..... as of December 2008 it is now December 2009 :j hopefully sooner!!
:jDEBT FREE:j January 2012, took longer but I got there, all by myself, through sheer hard work and pride!

Would him being sacked not effect his claim for JSA?

And why can't he just fill out the JSA3? It takes 5 minutes tops

I sort stuff for my adult children, they in turn do things for me. The alarming thing about the O/P for me is the inclusion of so much info about the son's life.

waiting in for a delivery or a lift somewhere I can understand but effectively giving over your only source of income to someone else to deal with......no. Sorry, just don't get it, surely if you are not working you have plenty of time to do these things and look for work. Imagine a random question from a prospective employer and the (honest) answer is " my mum/dad sorted that out for me"!! Not so impressive.

Your adult offspring may help you with the odd errand, but I seriously doubt that the DWP/Jobcentre would discuss anyone's claim with anyone other than the person claiming unless under extremely exceptional circumstances!
