PayPal Chargeback!!!!! PLEASE HELP

First time poster in need of some help and advice.

Just to give you a basic outline. On the 19/12/09 I sold an item on ebay for £130 that was paid via paypal. I noticed the buyer lived on the other side of the country to me so I paid and printed postage via paypal. I then got a email saying they wouldn't need P&P as it was for a relative that lived local to me and they would contact me to arrange a convenient time for collection, (so asked for and got a refund from paypal for my P&P) which was done on without a problem by a smart well spoken gentleman.
What a nice smooth transaction!
Then on the 28/01/10 I get this!!!!!

Dear ,

We were recently notified that one of your buyers filed a chargeback. This
simply means they asked their credit card issuer to reverse a payment made
to you purchased on 19 Dec 2009.

The buyer claims that this purchase was made without their authorisation to
use the credit card. Their credit card issuer needs additional information
from you about this transaction to help resolve this.

I'm now -£125 and I'm shocked that they could have taken the monies from my account!!!

On checking the buyer only had 2 feedback and I have a block in place for anyone with less than 5????
So I checked with ebay and was told " that because the buyer was a good and proper user with a verified credit card they were allowed to bid?????
With more digging it turns out that this good and proper user does not live at the address registered with ebay and the mobile number given is false and the verified credit sounds also to be false!!!!!!!:mad:

I'm also not the only person to be stung by this well spoken gentleman
I contacted someone else who had left feedback on this account and he has a charge back of £250 against him!!!

Surely this should be a fraud case to be dealt with by the credit cards insurance? and not funded by innocent ebay sellers. I'm unemployed due to injury and redundancy and was only trying to raise some christmas money for the kids so £130 is a massive amount!!!

    I'm afraid your a bit !!!!!!ed, because you didn't send it you can't defend the chargeback. You are protected against fraudulent use of a CC with paypal just with proof of posting. As the buyer picked the item up you wont have this.

    I know its a bit late but even without the CC fraud by allowing pick up you left yourself wide open to a scam.

    Also you cannot block bidders with low feedback you can only block those with negative feedback or NPB strikes

    I know its not what you want to hear but you don't have any comeback via Paypal or ebay.

    If you cannot prove delivery then I am afraid paypal will find in favour of the buyer. I have had it happen to me once before for a voucher code I sold for £9 and sent by email, the buyer left good feedback but a few weeks later I had the same as you and as i could not prove delivery Paypal found in favour of the buyer and also charged me an extra £7. I now send everthing tracked and if it is collection I will only accept cash.

    As its fraudulent use of a credit card this is the only case where paypal accept proof of posting as a defence, but obviously the OP doesn't even have that
  • I almost fell for a similar possible scam. The guy has 2 feedback and bought a phone from me for £150. Then he asks me to send to another address but i told him 'no' and sent it to his ebay registered address with special delivery. Hopefully he won't sting me.

    This is such a common scam and we were discussing the possibility on another thread only a day or so ago.

    OP, I'm sorry but there is no way at all I can think of for you to recover funds unless you can positively confirm the buyers home address and name, and link him to that address and go via small claims.

  • If this is what seems to be a common scam why is there not more support for the seller?

    this seems to be a stolen or cloned card, should this not be covered by the credit cards insurance? How and why should an innocent person be punished?
    If the holder has not reported the card stolen then should they not be liable? he say's clutching at straws

    To top this off the scammers account is still open even though its been reported twice and by two different people!!!

    In the event of a charge back you are covered, you have proof of posting and if it is delivered you will have proof of that as well, just make sure you quote paypal rules chapter and verse at them, they are a bit thick when it comes to their own rules.

    Scams only work because people allow themselves to be scammed. This scam in particular would not work at all if people understood the rules and requirements.

    There are scams we can do nothing about, I'd rather paypal concentrated on them but in this instance there are plenty of warnings around and paypal rules are very very clear and I really do feel for the OP but a tiny bit of research or understanding would have saved him all these problems.

    Oh and it is covered by the credit card insurance, that's why buyer is getting a refund. If there wasn't any credit card protection then seller would have bene fine.

    Trouble is - it's not your credit card.
    If you still have contact details for the seller you could try contacting them by phone / letter. Couldn't hurt.

    Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j

    Hi, I just had a £230 chargeback from someone I sold a set of wheels to back in November, exactly the same message as the OP from Paypal who have taken the money. I have positive feedback from the buyer on Ebay, a FedEx tracking Number and delivery address, signed and dated. What do I need to do please as this is the first time it has happened and I am in unknown territory. I filled in the form for Paypal with the details they asked for but does this mean I will get the funds back? Thanks for your help. :)
