Item Not As Described Seller Refuses To Refund

in Ebay, auctions, car boot sales, post & parcels
Bought a cyber clubbing outfit for my daughter. Seller listed as size 10 and new without tags. Paid by postal order as this was the only payment option and sent it recorded delivery.

When i received the item it was covered in pink stains and no way was it a size 10, as my daughter has the same outfit in another colourway in a size 8 and she couldn't even get this suit on.

The seller is not interested, she insists its a size 10 and that there were no pink stains on the outfit and will not refund.

I have opened a dispute with ebay , what happens if i choose to escalate the claim with "standard buyer protection"or am i not covered because i didn't pay via paypal.

I haven't left feedback yet as i wanted to sort the dispute out first, she is an ebay newbie only 13 feedback.

Any suggestions on what else i can do.

    How much was the item? There is a £15 fee for standard buyer protection cases. If that's not acceptable, your only hope is to keep working on the seller. Could you e-mail them a picture of the outfit as you received it?

    Edit: PS. Don't leave feedback until you have exhausted all possibilities with the seller.

    threaten with a neg and reporting them?? see how co-operative the become! it will damage them if they only have 15 feedback!

    Tut tut, Angel! :naughty: Feedback threads are against ebay's policies. Very tempting, though. :D

    Don't threaten her with a negative, tell her she is having a negative and carry it through. Too much dilly dallying about negs has left you in this situation and if you do nothing will leave others in the same position.

    It is the responsibilty of every buyer and seller on ebay to leave prompt truthful feedback if they are going to leave any at all. Only then can you out rougue sellers.

    The outfit was £21.00 , the seller is adamant regarding condition and size and she just replies "what are you telling me this for" she is not interested

    My feedback is 99.8% so i can take a tit for tat negative

    It sounds like you'll have to start the buyer protection claim, then. If you can convince ebay about the condition of the outfit, you should get £6 back, but perhaps more importantly the seller will get a strike put on their account, which will set them on their way to losing it. Be sure to mention the seller's attitude when you leave your feedback.

    As do I. The difference is I am very unlikely to be reported to ebay in the unlikely event someone finds out what it is, whereas feedback threats, justified or otherwise, give the recipient a much sought opportunity to make a complaint.

    Nope multiple identities are allowed on ebay, in one of their old selling tutorials ebay even suggested it.

    All my id's are properly registered with real details and backed with a credit card.

    The only thing that isn't allowed is for those id's to bid on one of the other id's.
    Edit: There is another disallowed thing with multiples, and that is that if you are blocked from a sellers auction for any reason you are forbidden to use your second id to place a bid on that same auction. If a seller suspects that a blocked or 'unwelcome' bid has been entered there is a special section on the contact form for reporting the secondary id to ebay.

    I tried looking for the bit about secondary id's but I always find the help section on ebay confusing to say the least!

    However, this link takes you through to a page where it tells you how to combine your multiple id's (you wouldn't be able to combine them if you weren't allowed to have more than one):
