Credit Card Fraud - What now?

Last month I was a victim of a theft and the thief got access to my credit card and charged over £2500 worth of merchandise before cards were cancelled. Since the thief was able to break the pin, the bank has refused to honor the claim. Anyone know if there is a way to force the bank to pay up. I did not give the pin number to the thief, so either he found it out and targeted me. Has anyone experienced this and able to offer any advise. Can try an FOB, but it can take 6 months to get a result.

    As set out in the banking code the bank has to prove that you have been negligent with your pin number, so your first action is to ask them for proof in writing that you did not protect your pin.

    Chip n Pin is'nt secure as the banks are making out, I'd be livid if that was me. who are the bank to say they are not honouring the claim without giving you the evidence/proof beforehand that you were at fault in all of this!!.
  • they said that since the person was able to figure out the pin, that I must have been at fault. I have tried to figure out who the person was, even did alot of the police investigation since they were too buys. Got CTV footage for them - they never picked it up - 3 weeks later they got one of them, but it was poor quality, even got a description of the vehicle - which was unique Purple Audi C2 or A2 (dont know Audis), description of the perp from one of the stores. But police wont show me his photo, so dont know if he knows me. Could have gotten my pin from spying on me or how ever these thieves do it. I just need to find someone who fights this type of fraud. The banks earn money off me every day, they should make it so you have to use a pin and show photo id. Chip and pin is a security joke and I am paying for it while the bank makes a mint everyday.

    Just because someone figured out your pin is not proof that you have been negligent with your pin number - they still have to prove it. Don't let this drop, demand they supply you with all the evidence they have as proof.

    I know you don't really want the hassle of going to FOB but it might be worth doing anyway.

    May I ask which is the Company involved? I ask,because I had almost the same thing ( my card wasn't stolen but cloned) and used with the PIN or so the bank said, but I asked them to prove that I had been negligent with my PIN and it transpired that the fraudelent items were swiped not PIN authorised. I had an apology, all the money refunded, and an ex-gratia payment to my account. Get onto the Fraud department and ask them for the transaction slips. Write to them using Recorded Delivery for the slips. Hope this helps.

    Sorry to learn of this dreadful experience.

    You need to persue this with the bank in an ascertive manner. As other posters have said, the onus is on the bank to prove that you were negligent with your PIN. If they cannot, then they should refund you all the fraudulent transactions. They are required to do this by the Banking Code, and it appears they are not following this.

    Personally I would make a formal complaint and if this does not produce a positive result, then raise a complaint with the Banking ombudsman. It is YOUR money and they should refund you.

  • thank you to all for your replys ..sorry for delay but have been away working. Have read all the stories and watched the videos - thank you - very enlightening. I have contacted an attorney friend who is giving me advise and we will probably lodge a formal complaint with the FOB. For those asking - it was Natwest Bank that is refusing to pay up.

    Will let everyone knows what happens - but looks like if it goes to the FOB, it could take up to 6 months.
