Hi I hope that this is the correct board.
Yesterday Mrs Watchwoman (my wife) received a letter from a H. L. Legal claim that they were representing a company under the name Telogram or/and CapQuest Investments Limited.
I Googled Telogram and it looks like it is a dept collection agency.
In the letter they were referring to my wife as Miss R####### which is her maiden name instead of the correct Mrs Watchwoman. We are married for four years and we are together for eight years. My wife is not aware (or at list she is not remember) any old outstanding dept whatsoever.
Here is a copy of the letter.
If we don’t call them we are afraid that we may have the bailiffs knocking our door.
However Mrs Watchwoman can not remember of any debts.
Not sure what to do. Any advice please?

This is a fishing trip.
They may well have sent the letter out to a whole horde of people who have the same or a similiar name, in the hope that one will reply and cough up some money.
If Oh actually owes and money, which seems to be unlikely, and a door step collector turned up, he has the same rights as the paper boy and if he did not leave, you could get him removed by the police. Having said that the chance of anyone turning up border on nil.
it is the responsibility of the DCA to prove that OH has a debt, NOT your responsibility to prove otherwise.
I would report them to all the regulatory bodies as the are breaking the rules.
Will be back with the list and the OFT GuidelinesIf you've have not made a mistake, you've made nothing0 -
here's the list
if you click the OFT liunk, you will find the link for guidelines for debt collectionand somewhere there is a complaint form.
You need to report them in writing to the TS nearest their office. my guess is the HL legal services is either the legal "department" of Telogram or Capquest and it is quite possible that the letters were generated form one of the legal letter we-bsites and they have no qualified staff at all.

(note: I chose to complete and download the .pdf form on Data Protection, which I am also sending to the other offices, with an accompanying letter)

-Please note, you can search by inserting the postcode in the top right hand corner, remember to use the postcode of the DCA rather than your own-

Hi,this is Mrs Watchwoman. I just wanted to say thankyou for all your advice:T .
As you can imagine I was very suprised when I got this letter as I know that any past debts I have had have been paid which is why I was very suspitious of these.
If there was a debt,it has to be at least 9 years ago and I dont remember it so as far as I am aware any past debts left over 5 years are void.
Is this right?

Hiya mrs
Are you in Scotland? it is five years there.
In England and Wales it is 6 years from the date of the last payment or acknowledgement, unless there is an outstanding CCJ against the account.
However, it is perfectly legal for a creditor or DCA to ask someone to pay an older debt. It is against OFT Guidelines for them to pretend to you that they could enforce the debt throught the court system. If however, you wan tto pay, that is up to you.
On the other hand, you can send them a statute barred latter, and once they have been told that you will not pay, they must stop pursuing you. However, if you read privateryan's saga on here, it takes some of them a while to get the hint. Others desist immediately. If you've have not made a mistake, you've made nothing0 -
Hiya RAS,
I actually live in England.I have never had any CCJ's so I guess the best thing to do is to ignore the letter.
I know someone tried to ring a few weeks ago while I was at work,my hubbie took the call and said the person on the phone sounded very aggressive, when they asked for me he just replied they had the wrong number and he's never heard of me.
My hubbie is always going on about how great this site is and I can see why!0 -
I would just send the letter back saying that this person is unknown at this address

Rob Strictly that is not true.
Since mrs NW is in a position to tell this lot to take a hike if by any chance they are chasing her for a debt she used to owe, it may be less trouble in the long run to deal with it.
ignore them until they come up with something that actually tells you what they are chasing. Then come back here for the letter. If you've have not made a mistake, you've made nothing0
