Hello everyone , Just had a light bulb moment !.....:j .. I,ve requested a signed copy of Consumer Credit Agreement from two collection agencies . Plus proof of assignment ,so i know that i,m paying the correct people . So far its been 3 weeks since they recieved by recorded delivery letters . They now have another 3 weeks until they are in breech of the C C ACT.
If everyone who was being pressurised by these agencies were to do the same , request CCA , the chances are they would be snowed under ! And the question is how many would they be able to produce? There are template letters available , so come on everyone , give it ago !!!!!!!! You will lose nothing and maybe end up better off . GOOD LUCK:T :j

    But are the loan companies that sell your debt on to collection agencies ? Looks like mines has been to several companies . For a start how do i know i,m dealing with the collect people? Could more come out of the woodwork ?
  • If the first fail to come up with it, they sell the debt on so you still get chased. In the end if you owe the money it's easier just to pay it.

    Perhaps you would be best advised to post an SOA listing your income, expenditure and, especially, your debts.
    Which debts are being pursued by dca's?
    You do have the right to request a cca from anyone who is chasing you for any 'alleged debt' whether or not they are the original creditor. However - without knowing what the 'debts' are, then it is difficult to know if requesting a true copy of the original signed cca is your best option.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.

    If you get a copy of your credit reports, this will show you what credit agreements you have - so I think if you're dealing with everything on that, then it's unlikely anything else will "come out of the woodwork". No doubt someone wiser than me will be able to confirm that for sure?

    If you're not sure that you should be paying a company money (for example where your debt has been sold on), then yes, I think it is a good idea to request the credit agreement from them.

    Personally though, I'm aware of which companies I owe money to (and that I did in fact borrow the money), so I am just paying back what I owe...

    You might get some more concrete advice if you posted up your SOA?

  • I agree, ask for a copy of the CCA !! Most companies file the paperwork away in a cheap mass retreival system, as the law says they should. However, shoving the paperwork in a old tin mine may be cost effective, it makes actual retrieval somewhat expensive and usually prohibitive. They can't and don't keep everything to hand so it's always worth a go. I personally do not see this as a loophole. They know the rules and if they want their money back, all they have to do is Prove IT.As for deed of assignments, they make these up as they go along......
