Debitas Legal Services

I have been reading some earlier postings regarding Debitas Legal Services,which I believe is the debt Collection Agency for Capital One.

My husband owed just over £1,400 to Capital One who transferred the account to Debitas.We entered into an arrangement with them to pay £15 monthly by standing order until the debt was cleared.

We have maintained this arrangement and the outstanding debt now is just £139.00.

Last week my husband had a number of calls from Debitas,alleging that the agreement had been broken because a payment was late due to the Easter Bank holiday,the due date being Good Friday when the banking system was closed.We said that the payment had been made,as usual,but we could not help the fact that it was late due to the holiday.This cut no ice with the very unpleasant Debitas caller,who then asked my husband to pay off the remaining debt by debit card.

My husband declined to do this,and said we would continue with the existing arrangement,given that the debt has only a matter of weeks to run.

He was then told that this was not possible and he would have to request a new arrangement.The caller was rude and officious.My husband was informed that he would get another call in four days.My husband said it would have to be after seven in the evening as he is not home from work until then.The caller said 'we'll do our best.'

Last night,we received two calls from Debitas after eight,but when we answered there was no-one there.We rang back (it is an 0800 number) but an automated service informed us that the office shuts at 7pm.

We are assuming,given their earlier discourteous manner,that they had set the automated service to ring our home after they closed.I think this is unacceptable.

I don't know why some of these DCAs set themselves up as judge,jury and executioner.

Does anyone know who regulates these agencies,as I would like to make a complaint about the manner of this particular company.I would also be interested to hear if anyone else has had contact with Debitas and has been treated the same way.

    Hi and welcome.Just stick to your guns on this one. ont be bullied. You do not need to make another arrangment wit them. Dont ring them and do not speak to them on the phone if they ring you. Now. were there any charges on this cap 1 account. How old is the debt. Have you claimed back charges from any of the companies you are in debt to.

    Debitas are a DCA who collect for a number of compaies. Not just Cap1. Do you know if they have bought the debt. Or just collecting on behalf of Cap1

    Hi,

    I'm not sure if Debitas bought the debt or are collecting on behalf of Capital One.I remember when we had the letter from Cap One saying the debt had been 'passed to' Debitas,and from then on Cap One would not speak to us.

    Once we had entered into the arrangement to pay £15 monthly by standing order,all charges were stopped.

    What annoys me with their recent calls is that during the lifetime of this arrangement,which,as I said before,we have never defaulted on,there have been other Bank holidays where the payments would have been delayed,but nothing was said before.

    The amount left owing is piffling in comparison with the original debt,and I cannot help but think that they are trying to 'clear up' small amounts.Despite my husband telling them that we are not home during the day,they are continuing to call.Our phone stores unanswered numbers and sometimes they are calling with just ten minute intervals between calls.

    What really gets to me though,is their surly attitude.Are all DCAs the same,or is Debitas particularly unpleasant?

    Hi Marisan - sorry to hear about your problem - Capital One were very quick to put the Debt Collectors on to me, as well.
    However Debt Collectors MUST conduct their 'business' within the terms of the guidelines laid down by the Office of fair Trading (OFT).

    Hi again,

    It just gets better.There were four telephone calls to our home yesterday by Debitas,two within five minutes of each other (we are at work during the day,as we told them).

    The telephone rang at 8.30 pm,my husband answered,knowing it was Debitas as it the number came on the caller display,and they hung up on him.

    Fifteen minutes later they rang back and this time they spoke to him.

    They still insist that the agreement was broken due to the Bank Holiday,although they were not able to answer why last year,when the same problem would have occurred,they did not get on to us then.Neither was the female operator able to explain why we were getting harrassed now when the outstanding debt is so small (now just £139!)

    My husband informed them that he intended to report their business methods to the OFT and was told to go ahead.

    The operator then mentioned that they might take the matter to Court.My husband told her that he believed that the Court would not look kindly on a creditor taking someone to Court over such a tiny sum,especially when payments were being made regularly.

    The operator then told my husband he was being 'silly'.

    My husband then asked for the name of Debitas' parent company or a Head Office address,but the operator suddenly appeared to have gone deaf.

    She would not let my husband get a word in edgeways,but he is very persistant,and finally,the operator decided that it was time she went home (she actually said 'I finish at 9!) and the call ended.

    What charming people they are.

    Hi again,

    It had been a bit quiet for a few days after the evening telephone 'conversation' but Lo! when we got home last night there were two missed calls from Debitas on our phone.:p

    We have not,and will not,ring them back.

    Meanwhile,the standing order payments are being made regularly and the debt now stands at £119.

    In fact,we could manage to pay this off now,but hubby is determined to be as awkward with them as they have been with us.

    Hi All,

    The final instalment in our Debitas saga.

    The debt we owed has been paid off in full and hubby has just received a letter from them to confirm this and to say that the account has been marked 'satisfied'.

    One of the problems we had in dealing with Debitas,was that we could never get them to give us a contact telephone number.All calls from them to us were 'caller withheld.'

    So,for anyone else dealing with these people here is some information from the letter we have been sent.

    As to the question of whether Debitas is part of Capital One (we asked,they wouldn't confirm or deny it) the small print at the bottom of this letter reads:

    "Debitas Legal services is a trading name of Capital One Bank (Europe)plc."


    Debitas is not the only collection agency we have had to deal with in our fight to get out of debt,but they are surely one of the most unpleasant and we are happy to have them off our backs at last.

    I should just clarify regarding the telephone numbers for Debitas.We had an 0800 number,but it was the Head Office number they refused to give us.Often we could not get through on the 0800 number.

    I'm dealing with debitas now and haven't had any problems....probably due to me being a mug and paying £20 a week!!
