Landlord gave some homeless guy a key to my flat while i was still living there!!!!

I have been in rented accommodation in gateshead for just over two years and I am due to move out on the 1st of February 2007, I informed my landlord with two months notice that I was moving out between the middle and the end of January. On Saturday the 27th of January the prospective tenant called to my door at 8pm, he is a homeless Romanian busker and he said that he had registered this address at the local job centre, he advised me that some mail would be coming and I said that I would leave it here for him and at that point he said he would collect it on Monday. It turns out that he has a key for our flat for the last week; he viewed the flat on his own without my knowledge. My landlord had told me that he was showing the flat to someone and I had a greed assuming that he would be there with the new tenant. I called my landlord and asked him to take back the key to which he refused. I called the police fearing for my safety and was told to contact the landlord again, when I called him and told him that I had been on to the police, he hung up on me. Fortunately the busker had come back and wanted to put his bike in the cupboard, I demanded the key from him and he called our landlord and the landlord told him to give it to me so I now have all keys that I am aware of in my property.

I live with my sister and frankly I am appalled that my landlord would give a key to a total homeless stranger living in a tent, obviously because it was our home we had money, ankh cards, statements and valuables everywhere. I have been on to the landlord association, gateshead council and the police and unfortunately they cannot do anything against him. I am furious that he could put our lives in danger like that and allow a perfect stranger into our flat without us knowing, he advised the new tenant that he could come and go as he pleases. Is there anything that I can do, not only have I not slept since Saturday, I am worried about going to work and coming back to find all my belongings gone and no signs of forced entry. It disturbed me that the busker had said “the only reason I knocked was because I saw the light on otherwise I would have just used my key”. I have no idea if a copy of the key has been made and thankfully I am moving out on Thursday but I just want to know if I can stop this landlord from doing the same thing. He is a shocking landlord, the roof in my kitchen has been leaking for over five months, the gas boiler has been leaking for four and all the while he has been aware of this. I am a very patient an easy going person but the key incident was the last straw!
Any advice or help on this matter would be greatly appreciated.

    Sounds a bit like a scum landlord I used to have when living in Fenham. What was he called, Sheban or something. Hope hes been jailed, he was a complete menace to society that one.

    I would suggest that this is a breach of your tenancy agreement, and your TA is a legally binding document.

    I would alsop suggest that your LL has encouraged trespass which Im surprised that the police are not willing to intevene on. Id run this by the Independent police complaints commission to get a feel of any legal issues in this regard.

    As for breach of tenancy, I really dont know, but id be tempted to call shelter and see what they say, their helpline is usually clogged, but be patient they are likely to be able to give you a decent answer- sorry I cant. Would love to know how you get on, keep us posted.

    i know and it is so frusterating because he is such a crap landlord, he didnt repair a leaking roof for five months and i had dishes all over the kitchen and fell about eight times, gas boiler was leaking for four months and still isnt fixed hence why i am moving out and i think that on thursday i am going to have a hard time getting my deposit back from him. aaaaaaaargh!!!
  • I have no idea of the exact legal steps etc but I'm sure he must be in the wrong. I think the best thing is to gather up some evidence while you're still there. As it'll be really difficult once your not.

    If this new tenant comes round again, ask him to write/sign something that confirms when the landlord gave him a key.
    Write to the landlord telling him that you are unhappy with the situation, detail all of the incidences that you've mentioned above. and that you want confirmation that all the keys are held by either you or the landlord and noone else. Also write in there confirmation of your last day of your tenancy agreement (which you legally have the house until). Take a copy and send it recorded delivery.
    Take pictures of the other things wrong (the roof, the boiler). Just extra proof that he is a shoddy landlord.
    I'd go down to Citizen's advice. Legally, I've no idea of any of this but he must be doing something wrong. Especially if your tenancy agreement gives you the tenancy to the whole of the property.

    That is a really horrible situation and I'm glad that you're moving out. That landlord sounds really bad!

    im very easy going and to be honest if he had asked me if the new guy could drop some stuff around i would have been fine but he thought that i would never find out and its just by chance that i was in on saturday, i was supposesd to go out and decided against it, that guy could have and would have just used his key to come in, make a cup of tea whatever and that freaks me out. i havent slept a wink and that insensitive landlord had the cheek to say "well in fairness, the guy is homeless" ... let him stay in your house then if tyou are that worried about him was my reply!!

    i have never in my life heard of anything like this before but i swear i am not kletting this go, my sister and i had our safety compromised and it was his fault, there has to be something that we can do

    oh cant wait to get outr of there and in to my new flat rented through a letting agent!!!!!! 4 days and counting!

    SO much for Government's promise about who they would / would not allow to come to the Uk folllowing Romania joining the EU - an unemployed busker!!?? Like the country is crying out for buskers!

    Go to the local hardware store and get a new lock barrel for about £10 it takes about 20 mins to fit. Change it back when you leave.

    If you have a legal tenancy I.E an interest in land, then you have "exclusive possession", that means you can exclude the whole world from your land including the landlord. So boot him out with reasonable force.

    i just find it amazing that no one can do anything and he could possibly get away with this, he encouraged trespassing, he put our lives in danger and we could have been totally succebtable to robbery and the police cant or wont do anything about it.

    The first thing I'd do when moving into rented is change the locks. You're not supposed to, but (on the other hand) the Landlord has to give you notice prior to visiting a property.

    You are allowed "quiet enjoyment" by law, anything below this can be deemed harrassment. I agree you should change the lock. You have an agreement which allows the landlord access by agreement only, and you have an exclusive right to your property which has been comprimised. You could sue him, but I am not sure what you would gain.
