Thinking of taking phones2udirect to small claims

It's been about 2 months since I sent my cashback letter to phones2udirect, after many emails to them about the delay I got a one-line email which read "sorry...we have escalated your claim and will be dealt with shortly". It's been about 2 weeks since that email and i've still not recieved anything so I was thinking of sending them a final letter stating my intentions if I don't recieve cashback from them.

Has anyone done this before? If so, is there anything in particular I should mention in the letter?

    I had the same problem with a company called themobs.com. All four claims were a problem and they didn't pay out the first 2 claims until 7 or 8 months into the contract! I sent letter after letter, recorded delivery, to no avail.

    I used my local trading standards and they managed to get them to cough up everything. I'll never do it again, although my dad used onestophoneshop and they paid out religiously and on time, everytime with no chasing or hassle.

    Anyway, I would try getting in touch with your trading standards as they might prevent the hassle of having to go to court - it worked for me anyway.

    I sent my first 6 month claim to them with all the required documents via RM special delivery..not wanting to take a chance given their reputation..and today i got a letter from them saying that the envelope they got was empty. can u imagine..why would any one send an empty envelope by special delivery. i resend all the documents same day via another special delivery and i have not heard from them yet. If they deny my claim based on this i will have to take them to court via the small claims court. any advice?

    If I issue a claim against them, will they be liable for any charges I incur as a result of the claim or will I have to bear the cost of the claim?

    They will be responsible - you can issue a claim online for 30 quid, ask Mrs Moondragon for details as she has done this already

    At the risk of repeating my self I know......but I would recommend you report them to your trading standards office. It won't do any harm in any case and it might strengthen your case if trading standards are investigating them and you do go to court.

    As I said above, as soon as I got my trading standards involved themo0bs.com coughed up everything they owed and when they tried to renege on the other payments nI just told my trading standards again and they chased them up, hey presto I was paid again!

    These companies rely on inertia, however they don't reckon on most people using this site being far from those kinds of people.

    If in doubt, do both, report them to trading standards and go to court. The more people who report them to TS, the more likely the company are to pay you to go away!!!

    I hear what you're saying but to be honest, i've done enough waiting and I think the only way to get them to pay up might be the small claims

    Can anyone please guide me on how to approach the small claims court. I have sent a couple of letters (including LBA) to DAP but have received no response apart from an email stating they are investigating my case.
