fraudulent buyer on ebay- told to keep money??!

ok i was selling a mobile on ebay

it sold for about £330.

Now the buyer had setup a fraudulent paypal account and paid me with a stolen credit card. Everything in the paypal account was verified etc.

It was when the buyer asked me to send the phone to lithuania i had suspicions. Using directory enquiries i phoned the person who had had their credi card nicked. they confirmed they had been victims and asked me to ring Goldfish, their company.

I did and the guy at goldfish said it was nothing to do with me. the loss would be covered by paypal, visa or goldfish..

I know its all great and im alot richer (i didn't send the phone) but is all this right. i understand when goldfish said its not my duty to come to them but their duty to come to me, he said they probably won't ry and recalim the money though.

I'm just confused why no one wants the money back lol. i daren't spend it but i start uni soon and it may not last?

any help appreciated

    Its not your money. Dont touch it.

    Goldfish are misleading you. As its not for a small sum, they will eventually reverse the transaction via paypal and paypal will deduct the money from your account before you can say "ah!"

    You CAN refund the money. It will go back onto the credit card it was taken from (whether cancelled card or not) and your fees will be refunded too.

    It will be out of you hair then. Paypal and you can prove where the money came from and where it went too but ONLY use the refund link on the detials page of the particular transaction.

    Adding a bit here - Goldfish should never have discussed ANYTHING with you about this card - as its not yours. Thats where the misleading is coming in I think.

    I think I would expect PayPal to come after you for it at some point. Personally I wouldn't refund it, as you say the original credit card is cancelled so refunding may send the money into a black hole (for a while at least) and PayPal will probably still want it back off you.

    Ok, but the money's in my bank account. (i transferred it as soon as he paid me.)
    Goldfish didn't discuss that particular credit card but in general terms.
    sorry for not makin that clear. i emailed paypal too but they just replied with a copy and paste answer.

    Nobody wants the money, including me lol.

    spoke to paypal and she said wait until we contact you. under no circumstances should i use the refund button.

    i think il put the money back in my paypal account to be safe.

    this is more hassle then i imagined.

    ok im sorri to bring this up again... but nowts happend!!! I put the money back in my paypal account and its just sat their looking happy lol.

    does anybdy think it will be claimed????
  • Just leave the money in your PayPal account. At some point it will probably be reversed by PayPal.

    I think you have done at least as much as you should. You've contacted Goldfish and let them know. Bank it, get the interest, be prepared to pay it back as soon as someone grumbles. ;)
    If you lend someone a tenner and never see them again, it was probably worth it.

    Where there is a claim for fraudulent use of a credit card it can take months to settle. Therefore at some point in the future you will get notified by paypal that the issuing card have reversed the transaction, and they will either take the money from any available balance you have, or put your paypal account into a negative balance. If you paypal account has a negative balance they will ask you to pay money in to cover it quickly, or chase you for the debt.

    It could be a few months though before it gets that far as both the CC company and paypal have to follow all the correct procedures. If it were possible to just claim fraudulent use and for thebuyer to get their money back the next day it woul dbe mor eopen to abuse than it already is. This way at least they weed out the scam claims and deal with the mercifully few real claims of fraudulent use.
