Customer complains about USED TomTom 910 De Luxe that I sold.

Would you send out goods that are not working, NO WAY... The first thing one does as in my case to make sure everything works as stated on you sale advertisement via Amazons seller site (HAVE YOU ONE FOR SALE). What is the point sending USED goods that do not work. Any customer would not accept this and rightly so.

SOLD Tom Tom 910 DELUXE Version with lots of extras. Cost me from new over £340. NO USE ANYMORE USED BY ME ABOUT 15 TIMES LIKE NEW NO MARKINGS NO SCRATCHES ON SCREEN SOLD AS NEW. Sold via Amazon for £119.86. All parts CD, instruction manual etc., on how to use it was sent everything including original packaging as received by me in first place from Comet Electrical Store.

Email from buyer, could not use it (does not work), I replied, I checked everything before dispatch, even setting up the persons post code so when switched on it will be displayed on the screen.

The TomTom 910 is up market with FULL EUROPEAN USA AND CANADIAN MAP ON IT. Buyer must have the Canadian map as she is going to Canada in a few weeks time. I gave her my telephone number, she already had my address when I sent the goods, so she can contact me, also requested her telephone number just in case she cannot contact me.

Email from the buyer cannot telephone me, working at night. NO CONTACT NUMBER ON THE BUYER'S SIDE to sort out the problem, which I was sure there was none.

Email from buyer leads are missing, no plug for USA. One has to take the UK plug off then place the USA or EU plug to charge the unit. Pointed this out. NO REPLY for over one week. Thought all is OK.

Now Amazon was involved, buyer complained to Amazon Tom Tom does not work. I sent all detail as above to Amazon. No reply from Amazon that they received my email with all the facts stating the buyer has not contacted me to sort out the problem.

Few day later email from Amazon that they have given a full refund to the buyer £119.86. BUT WERE IS THE TOMTOM I SENT TO THE BUYER. No reply from Amazon. Unknown to me at that time that I was out 12 hours in my reply to Amazon of the buyer complaint.

NO WAY WOULD AMAZON REFUND ANY MONIES TO A BUYER WITHOUT THE RETURN OF THE GOODS FIRST, THEN CHECKING THE GOODS IF FAULTY BEFORE ANY REFUND.

The buyer was laughing her head of to obtain a FULLY WORKING TOMTOM 910 on her way to Canada and have proof to the facts in her own wording as below.
THE TOMTOM IS IN FULL WORKING ORDER AND THAT IT IS AMAZON’S FAULT FOR NOT ASKING TO HAVE THE TOMTOM RETURNED TO YOU. SO YOU SORT IT OUT WITH AMAZON AND GET YOUR MONEY BACK.
NOW SHE IS IN CANADA... OR IS SHE.... I THINK IT WAS A SETUP....SADLY I WILL NEVER KNOW....

I have sent the full details to Amazon FIVE PAGES via THE ROYAL MAIL, NOT ONCE BUT TWICE IN LETTER FORM, addressed to The Managing Director, AMAZON Co.UK, Patriot Grove, 1-9 The Grove, Slough, Berkshire SL1 1QP. Up to this date I have not received a reply by letter, nor any offer of a refund. I HAVE LOST £119.86.

THIS PERSON IS USING MY UNPAID FULLY WORKING TOMTOM WITH A BIG GRIN AND THANK YOU VERY MUCH FOR THE FREE TOMTOM.... AMAZON. com. UK.

ANY ADVICE.... HOW TO RECOUP THIS LOSS WOULD BE GREATLY APPRECIATED. THANK YOU.

    Speak to your local citizens advice centre - it may be worth paying them a visit rather than phoning them as I've never managed to get through to mine.

    Hi, thanks in advance for any help.

    Recently i sold my Tom Tom (model and features briefly) over Amazon market place for £XXX.XX.

    I posted the goods and once received, the buyer disputed the description of the item despite it being fully correct. I believe the buyer had merely misunderstood the description as far as I can tell which is not my error.

    The buyer took this issue to Amazon and when I emailed my defence to Amazon, the buyer changed their story and said the item did not work at all which i know to be untrue as it was fully working when sent.

    Amazon never responded to my defence and without me being able to intervine they took my money with no instruction on what happens yet and without allowing the chance to inspect the buyers claims.

    I am now out of pocket of a Tom Tom and £XXX.XX and don't now what to do, any suggestions?

    Thats 3 threads with little to no grammar or knowledge of a spell checker today alone.

    This one isnt as bad on spelling but grammar is worse than those emails you get telling you your free laptop and begillionsquillion dollars have arrived at their depo ......:rotfl:

    Thank the lord I don't have to choose Tory or Labour in May. Mind you, we have our own bunch of muppets this side of the water.

    Tell me about it. Go to school, work hard, pay massive expenses and get into massive debt in uni to get a degree for an industry collapsing due to poor credit control OR drink, have sex, have a child, stay home, get free money and laptops.


    Thinking about it now, I know what id like to choose so tbh I cant blame the kids who do it!

    Unfortunately I like working for my living despite still being young.

    Lib dems are looking pretty sweet right now tbh.

    Just one point as I can't really follow the OP at all, but you were in breach of Amazon terms and conditions as you appear to say you sold a used item as 'new'.
    Therefore buyer can claim the sale was misleading and under Amazon T and Cs the buyer is entitled to a full refund.
    If you think ebay is strict you should see some of the Amazon terms.

    Lol when did I ever claim to be perfect?

    The odd type and spelling mistake is fine but a massively incoherent, waffling post with random caps and arrows is just annoying. Add to that poor basic grammar and spelling and you have a disaster of a post.

    If you need help, you can at least make the thing easy to understand.

    Out of interest, what did I misspell?

    This poor person has been ripped off & is asking for advice & the first response is an insulting slagging off.
    Some people cannot help it if they did not do well in English at school so give them a break. MSE is about helping each other not using posts for
    critisizing people.

    Having just sold a large item on Amazon myself & posted yesterday, the OP problem has me a little worried now.
    I would suggest Citizens Advice too
