Parking ticket - Enforceable????

I got a parking ticket the other day - completely deserved and of course I will pay although it will hurt!!!

Anyway, the details on the ticket are wrong. They have my number plate correct but not the make and colour of car - how they can say gold is silver is beyond me and since when was a vauxhall the same as a clio??

My question is, if the details on the ticket are incorrect is the fine legally enforceable? If I wanted to argue about it would I have any grounds to do so??

    Parking wardens have to record such information as colour and make of vehicle.
    Just write to the council saying that details on the ticket are wrong making it invalid and please cancel it.

    Would that work?? Wardens here take a picture of the car whenever they issue a ticket in case of disputes later. Does this over-ride the information written on the ticket? They have, after all, got the correct colour/make in the photo together with the number plate on both the ticket and the photo so would the incorrectly recorded written information matter?

    As far as I am aware all of the details, even the reg, is simply to help to pursue a case should a person claim that their vehicle wasnt there at the time. As you say the majority these days have digital cameras which makes the rest of the form a little pointless. The date is the only possible one that could have an effect on it as you can justly state your vehicle wasnt there at the time the ticket states it was made out but then the photo will almost certainly be time/ date stamped and the error probably just accepted by the court as just that.

    At the end of the day, as you say you deserved the ticket so just pay up and put it down to your own mistake.

    I agree with the previous poster who said you should just pay as you say that you deserved the ticket - if you try appealing against it you can end up paying more.

    The "Penalty Charge Notice" is for a silver Vauxhall illegally parked and not a gold Renault. It cannot be changed later. Send a photo copy of the ticket with your letter explaining their mistake.

    They take photos to prove that the ticket has been put on the car, if you drive away before the ticket is put on the car or it is not handed to you, the ticket is invalid.

    Don't pay, the ticket is not valid.

    I agree with the comments geo555 has been making as you don't need to pay the ticket whose details does not match the description of your car, therefore the ticket is not enforceable. Imagine this: You witnessed a car that was involved in a hit and run. You gave the police the description of the car, i.e. colour and make (a Gold Renault Clio and the car reg), when in fact it was a Silver Vauxhall. The police will be on the lookout for the Gold Clio whilst the Silver Vauxhall is speeding around and possibly out of the area. The Result: a waste of polices' time and effort. Thankfully and fortunately for advancement in technology, the police should be able to get an instant record check from the dvla to see who the owner of the description you supplied. Once they have the correct details they can put this out to the patrol cars and some of the Traffic cops which will be able to check the registation plates of every car passing by from their onboard computer and hopefully stop the correct driver, when the system alerts the officer(s). :T

    From what you have said about what has been written down on the ticket, it sounds like somebody has cloned your plates (or in this case the traffic warden).

    Get "your ticket" CANCELLED! ;)

    don't know how long this site has been going for but I got a message about it from a friend yesterday, seems like a good idea to avoid parking fines in the future, https://www.fcukfines.com - Anyone else registered on it already?

    :think: Hmmmm, I don't think there is a way to find out whether your plates have been cloned until something lands on your doormat, i.e. penalty notices or fines. :eek:

    You say the parking ticket was deserved so presumably the ticket was actually on your car when you returned to it. Therefore, we are not talking about a cloned car as you know it was on the correct vehicle. You can mistake gold and silver. We took what we thought was a bronze car for a test drive but once away from the garage and in a different light, it was actually silver so I would be prepared to accept the colour of the car was skewed by light conditions but the make of car is on the tax disc if nowhere else so that is just plain daft.
