Wescot Letter

I have just recieved a letter from WESCOt saying I have to pay nearly £100, but it doesn't state anywhere onthe letter what the debt is for.
No idea what to do, worried if I ring they may try to bully me into paying, but I don't want to pay for something that I know nothing about, or may have paid off already (i had thought all debts were cleared.)
Its gone to my parents address, also not mine, and don't want them having a black credit mark.

any advice???????????

    Tell them where to go! The barstewards are just trying it on! But do phone them up to ask what it's for. Come back here with their response but don't agree to anything! If you are feeling overwhelmed/pressured just hang up! :D

  • right. have rung them up, need some more advice now.
    they say it is a debt relating to an account opened in Sept 1998, with "Shop Direct" which from what they could tell me could be any one of several catalogues. hung up before giving them any further details. i suppose its possible it is mine, i know i;ve cleared everything from the last 6 years off my credit report, so any advice please on where to go or what o do now.
    should I just pay it, or if not, what do I do?

  • OK, after six years they can not do a thing. So all you need to do is remind them of the statute of limitations relating to debts. They can not get you into court with this debt, so what are they going to do? I'd just forget about it and return any further correspondence unopened.

    If you haven't received any correspondence from them or paid them any monies in the last 6 years then the debt is satute barred!

    If you have received correspondence or paid monies to them ask them for proof of a signed credit agreement! ;)
  • sorry for being stupid, but do you mean I should write to them and point out the satute of limitations, or should I just ignore them. this has upset me so much when I thought everything had been sorted, i'm sat here in a right tizzy.

    Well it depends whether you have had any correspondence from them in the last 6 years or whether you have paid them anything in the lasy 6 years? :confused:
  • I haven't paid them anything, nor had contact with them regarding this debt. have had contact and paid with a couple of other debts but have just checked through my files and theres nothing relating to this company (shop direct) or this debt at all.

    In that case, phone them and deny all knowledge of this debt. Also tell them that "if" it has got anything to do with you it is now statute barred and you demand a letter stating that no monies is owed by you to them or Shop Direct. :D

    Don't take no for an answer and if they get threatening or anything remind them that they are goverened by rules and guidelines and you will report them necessarily to the appropriate people for example The Office Of Fair Trading or Financial Ombudsmen. This is all really just to put the wind up them! They won't have a clue what your on about! ;)

    I wouldn't phone them if I were you. They will do their darndest to tie you up in knots. You want to start off by letting them know you know your stuff and mean business. Then the boundaries are set.

    If you are slightly confused about whether this may or may not be an old account that you might or might not have paid in the last 6 years, heres the letter to use.

    Copy of letter to use if debt has been purchased by a debt-buyer. Enclose a £1 postal order in payment of the statutory fee and send by Recorded Delivery. They have 12 (working) days to respond. If they don't supply it within 30 days, they've committed a criminal offence. Report them to your local Trading Standards office.

    Quote:I do not acknowledge ANY debt to your company. I require you to supply the following documentation before I will correspond further on this matter.

    1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) - your obligation also extends to providing a statement of account. I enclose a £1 postal order in payment of the statutory fee, PO Serial Number xxxxx.

    2. A signed true copy of the deed of assignment of the above referenced agreement that you allege exists.

    3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not under S189 of the CCA 1974.

    Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities.

    As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the CCA and therefore is a complete defence to any court claim that is issued.

    Take note at this stage, that any legal action you may contemplate will be both vigorously defended and contested.
  • thanks for your brilliant advice, its much appreciated. I can't decide what to do now. I can either as inmypocket says ignore them as its Statute barred, ring them as southern scouser says(can't say I fancy this one much, i got stressed ringing them to find out what the debt was, and they weren't too helpful on that front), or send them the letter as sportbeth says,
    only definate thing is as its statute barred i'm not paying it!!!!
    any further advice anyone?
